WHEREAS, there has this day been presented to the City
Council of the City of Newport Beach a certain Stipulatim Waiving
Findings of Fact and Conclusions of Law, and Stipulation for, and
Judgment and Decree Quieting Title to claim of an easement, in
the case of Albert Soiland, Plaintiff, vs, City of Newport Beach,
defendant, action No, 38552, which Stipulation provides among
other things that that portion of plaintiff's property in said
stipulation described, is free and clear of, unencumbered, or
unaffected by that certain easement for street purposes referred
to and described in that certain deed recorded in Book 159,
page 238, Official Records of Orange County, California; and
WHEREAS, it is the opinion and ,judgment of the City
Council of the City of Newport Beach that said Stipulation should
be entered into with the said plaintiff in said action, and that
it is for the benefit and best interests of the City of Newport
Beach that said Stipulation be executed,
NOW, THEREFORE, BE IT RESOLVED: That the Mayor and City
Clerk of the City of Newport Beach be, and they are hereby
directed, authorized and instructed to execute said stipulation
in the name of and on behalf of the City of Newport Beach,
I hereby certify that the above and foregoing Resolution
was duly and regularly passed and adopted by the City Council of
the City of Newport Beach at a regular meeting thereof held on the
