3 RESOLUTION CONFIRMING ASSESSMENT IN PROCEEDING
FOR THE WIDENING OF CENTRAL AVENUE IN THE CITY
4 OF NEWPORT BEACH BETWEEN McFADDEN PLACE AND "B"
STREET.

WHEREAS, in the proceedings for the widening of Central

Avenue between McFadden Place and "B" Street in the City of
9
Newport Beach pursuant to Ordinance of Intention No. 503 of the
10
City of Newport Beach, adopted October 20, 1941, to which
11
ordinance reference is hereby made for a description of the
12
improvement and the district and for other particulars, an
13
assessment and diagram have been duly filed with the City Clerk
14
of the City of Newport Beach and notice of said filing and of the
15
time and place of hearing on the assessment has been duly given,

and affidavits showing the publication and mailing of such

notice have been regularly filed with this City Council; and
I8
WHEREAS, at the time and place stated in said notice,
I9
the hearing on said assessment was had, and all protests and
20
objections, both oral and written, to the confirmation of said
21
assessment were overruled and denied by the City Council, and
22
this City Council has examined said assessment and diagram and
23
24
taken evidence thereon and is satisfied therewith.
NOW, THEEZYGRE, the City Council of the City of Newport
25
26
Beach hereby finds and determines that the said assessment has
27
been levied in proportion to the benefits to be derived from the
28
improvement and the said assessment as filed is hereby confirmed.
29
The City Clerk is authorized and directed to certify
30
the fact and date of such confirmation and to deliver the
31
assessment and diagram as confirmed to the Street Superintendent

of the City of Newport beach, and said Street Superintendent
shall record said assessment and diagram in his office and
shall give notice of the recordation of said assessment in
the manner provided for by law. Said notice shall be published
in the Newport Balboa Press, a weekly newspaper, by three
successive insertions.
I hereby certify that the above and foregoing
resolution was duly and regularly passed and adopted by the
City Council of the city of Newport Beach at a regular meeting
thereof held on the 3rd day of August, 1942, by the following
vote, to+wit:
