Home My WebLink About2672 - Light & Lighting Regulationsc 1 2 3 5 i 8 9 10' 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 y RESOLUTION NO.1111::� 4 WHEREAS, the Chief of Police of the City of Newport Beach has, pursuant to Section 3 of Ordinance No,0'of said city, submitted to the City Council certain rules and regulations concerning lights and lighting within the corporate limits of the City of Newport Beach, which rules and regulations have been promulgated by said Chief of Police for the purpose of enabling him to conform to the orders and directions of the Director of the Ninth Civilian Defense Region, which rules and regulations were presented to the City Council at a regular meeting thereof held on the 2nd day of November, 1942; and WHEREAS, in the judgment of the City Council of the City of Newport Beach said rules and regulations so submitted to the City Council by the Chief of Police aforesaid, are in all respects reasonable and will, in the opinion and judgment of said City Council, enable the Chief of Police to conform to the orders and directions of the Director of the Ninth Civilian Defense Region, for the diminution of lighting within the corporate limits of the City of Newport Beach, whether in or out of doors, and which might endanger coast —wise shipping in the waters of the Eleventh Naval District, or which might endanger the defense of the waters within the Eleventh Naval District; and WHEREAS, it is further the opinion and judgment of the (City Council of the City of Newport Beach that said rules and regulations so adopted and promulgated by the Chief of Police will assist materially in the successful prosecution of the war Iby the United States of America, NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Newport Beach approves said rules and regulations so LAW OFFICES OF ROLAND THOMPSON 1 0 210 SPUPOEON BLOC. HODGKINSON CHIEF In order to enable your Chief of Police to con- form to Public Proclamations Numbers Ten and Twelve, issued by Lieut. General J. L. DeWitt of the U. S. Army, for the dim - unition of lighting within the corporate limits of the City of Newport Beach, and in accordance with Section 3 of Ordinance No. 517 of said city, I respectfully submit, for your consider- ation, the following rules and regulations regarding lights and lighting within said city, such rules and regulations to be in effect during the hours between sunset and sunrise, and to sup- plant, as of the above date, the rules and regulations promul- gated by myself on August 10th last. 1. SIGNS, FLOODLIGHTIN�,,DISPLAY AND INTERIOR LIGHTING. Illum- imated signs and ornamental lighting of every description which are located out -of- doors, and flood- lighting which illuminates buildings or signs (including but not limited to all exterior advertising signs, billboards, display lighting, theatre marquee signs, illuminated poster panels, and build- ing outline lightin ), and all interior light sources (as hereinafter defined which emit direct rays above the hori- zontal out -of- doors, shall be extinguished. The words, "light sources," as used herein are intended and shall be construed to mean and include any light generating elements - and the bright portion of any reflector, lens, luminaire, transparency, or other equipment associated herewith for the control or diffusion of light. This Section shall not apply to illumination for industrial or protective purposes ex- cept to the extent provided for in Section 2 (b) hereof® 0 Honorable Mayor and City Council, Page 2. Newport Beach, California. October 25, 1942. 2. ILLU:AINATION OF OUTDOOR AREAS; STREET AND HIGIRVAY LIGHTTS. Il- lumination of outdoor areas and industrial and protective il- lumination shall be controlled as follows: (a) Except as provided in Section 2 (b) hereof, illumination on all outdoor areas (including but not limited to auto- mobile service station yards, outdoor parking areas, re- creation areas and outdoor structures and roofs) shall not exceed one foot candle at any point tiiinen measured on a horizontal plane at any level of such outdoor areas, and all outdoor light sources shall be shielded so that no direct rays from the light source are emitted above the horizontal. All interior lighting of every descrip- tion shall be reduced or controlled so that it does not contribute more than one foot candle of illumination up- on any outdoor area. (b) Variations from the foregoing requirements shall be per- mitted in the case of illumination for industrial and protective purposes, and from industrial processes, wheth- er interior or exterior, but not including street or high- way lights, only when and to the extent that it is necess- ary to vary from such requirements in order to achieve and maintain maximum efficiency; but only with the written approval of the Ninth Regional Civilian Defense Board, abtained in advance. 3. In addition to the restrictions hereinbefore imposed, illum- ination which is visible from the Pacific Ocean shall be further diminished or obscured as follows: (a) RESIDENTIAL, CObWERCIAL AP;D INDUSTRIAL WINDOWS. No light- ing shall be permitted behind windows or gla2md doors visible from the sea unless they are covered -by drapes or shades. (b) STREET AND HIGHWAY TRAFFIC. Subject to the exceptions hereinafter stated, vehicles shall operate at night with no more than two lighted driving lamps, regard- less of the direction of travel, and each such lamp shall provide a maximum of not more than 250 beAm candlepower. Normal rear lights, license plate lights and clearance lights (where required by law) are per- mitted. Vehicles which are classified as authorized emergency vehicles under the applicable Federal, State or local law, when operated by authorized personnel, and when displaying an illuminated red spotlight, and when responding to a fire alarm, or when in the immed- iate pursuit of'an actual or suspected violator of the law, or when going to or transporting a person who is 0 { 'ionorable I,:ayor and City Council, Page 3 Newport Beach, California. October 25, 1942 in apparent need of immediate emergency medical or • surgical care, or when responding to some other emer- gency involving the protection of life or property, shall be excepted from the foregoing provisions. (c) INDUSTRIAL AND PROTECTIVE ILLUMINATION. Light sources for industrial purposes and light from in- dustrial processes within areas visible from the sea, shall comply with the requirements of Section 2 (b) hereof, and shall also be shielded so that they are not visible from the sea at night; provided, that variations from these requirements may be permitted in the case of illumination fof, industrial and pro - tective purposes, and from industrial processes, whether interior or exterior only when and to the extent that it is necessary to vary from such re- quirements in order to achieve and maintain maximum efficiency; but only with the written approval of the Ninth-Regional Civilian Defense Board, obtained in advance. (d) OTHER ILLTT,ZINATION. Except as hereinabove provided in this Section 31 all other lights visible from the sea are prohibited at night, including but not limit- ed to light from fires, bonfires, parked cars, flash- lights and lanterns. Where the term "foot- candle" is used in these rules and regulations, the same shall be construed to mean, and shall mean, that degree of illumination given by the light of a "stand- ard" candle at a distance of one foot.
