3 WHEREAS, the City Council of the City of Newport Beach
• 4 did on or about the let day of March, 1943, by Resolution No.
5 2718, agree to sell to S. R. Monaco, M.D., Renato P. Monaco and

Armando M. Monaco, father and sons, as point tenants with the right
7
of survivorship, the following described property situated in the
s
City of Newport Beach, County of Orange, State of California,and
9
more particularly described as follows, to -wit:

Lots 8 and 9, Tract 884, as shown on a Map recorded
11
in Book 30, pages 11 and 12 of Miscellaneous Maps,
Records of Orange County, California.

And WHEREAS, the purchase price of said property was the
13
sum of $800.00, which said purchase price was paid in full; and
14
WHEREAS, it now develops that the City of Newport Beach
15
did not have title to the above described property on the let
16
day of March, 1943, and therefore could not deliver to said
17
parties above named a deed thereto; and
18
WHEREAS, the City Council of the City of Newport Beach
19
believes that it is for the best interests of said city that said
20
sale be cancelled and the moneys heretofore paid by the said
21
purchasers be refunded to them.

NOW, THEREFORE, BE IT RESOLVED: That upon the said
23
S. R. Monaco, M. D., Renato P. Monaco and Armando M. Monaco,
24
surrendering to the city of Newport Beach the deed to the above
25
described property, the Mayor and City Clerk of the city of
26
Newport Beach be, and they are hereby instructed, directed and
27
authorized to execute a cancellation of said sale in the name
28
of and on behalf of the city of Newport Beach, and said City
29
Clerk is hereby instructed to refund to said named parties the
30
said sum of $800.00 heretofore paid for said above - described
31
property.
