WHEREAS, EDGAR A. CATHRO and EDITH K. CATHRO, husband

and wife, have this day offered to the CITY OF NEWPORT BEACH, the
'

sum of $400.00 for Lot 4, Block 109, Section B, in the City of
5
P?ewport Beach, as shown on a Map recorded in Book 4, page 27 of
6
Miscellaneous Maps, records of Orange County, California; and
7
WHEREAS, the said price is a fair and adequate price
8
as and for the purchase price of said lot; and
9
WHEREAS, the City Council of the City of Newport Beach
10
deems that it is for the best interests of said City that said
11 I
property be sold for the said sum of $400.00; and
12 '
WHEREAS, the price offered is just, fair and adequate
13
and is not disproportionate to the real value of the property
14
above described.

NOW, THEREFORE, BE IT RESOLVED: That said property be
16
sold to the said Edgar A. Cathro and Edith K. Cathro, husband and
17
wife, for the sum of $400.00, free and clear of all encumbrances,
18
subject to the taxes for the fiscal year 1943 -44 and unpaid
19
improvement assessments of record. Also subject to conditions,
20
restrictions and reservations of record. The Mayor and the City
21
Clerk are hereby authorized and directed to execute and deliver a
22
deed for said property to the said parties upon receipt of the
23
24
consideration above set forth.
BE IT FURTHER RESOLVED: That the sum of 840.00 be paid
25
to Eugene Elliott, as and for his commission for the negotiating of
26
the sale of said real property to Edgar A. Cathro and Edith K.
27
Cathro, his wife, as joint tenants, said sum being a fair and
28

reasonable commission to be allowed in said sale, and said broker
.
30
being a licensed realtor of the City of Newport Beach.

I hereby certify that the above and foregoing Resolution

the 2nd day of August, 1943, by the following vote, to -wit:
