RESOLUTION NOt 6'
WHEREAS, there is now pending in the Superior Court
of the State of California, in and for the County of Orange,
Action No. 42947, involving that certain real property situated
in the City of Newport Beach, County of Orange, State of Calif-
ornia, and more particularly described as follows, to -wit:
Lot Two (2) in Block 338, Canal Section,
Newport Beach, as shoi7n on a map recorded
in Book 4, Page 98 of Miscellaneous Maps,
Records of Orange County, California.
AND WHEREAS, the defendant in said action is the
record owner of said real property; and
WHEREAS, the City of Newport Beach has been offered
for all of its right, title and interest in and to said real
property the sum of $450.00; and
WHEREAS, the City Council of the City of Newport
Beach deems -that said price is just, fair and adequate for the
interest which said city may have in said property, and that
it will be for the best interests and benefit of said city that
said City dispose of its right, title and interest in said
property in order that said property may again be placed on the
assessment rolls where it will bear its just burden of taxation.
NOi4, THEREFORE, BE IT RESOLVED: That a certain
stipulation entered into by and between the plaintiff in said
action and the defendant therein, wherein and whereby'said
defendant agrees to pay to said City the sum of $$450.00, and in
addition thereto pay to Roland Thompson, Attorney for the City
of Newport Beach and the Attorney for plaintiff in this action,
the fees which would be due him from said City for services
rendered and to be rendered in this action, the sum of $$100.00,
and that title be quieted in him on his cross - complaint, subject,
however, to'the matters in said stipulation mentioned, be and the

same is hereby approved, and the Mayor and City Clerk of the City
of Newport Beach are authorized, directed and instructed to
approve in writing the Stipulation this day presented to the City
Council of the City of Newport Beach, on behalf of said City of
Newport Beach.
I hereby certify that the above and foregoing
Resolution was duly and regularly passed and adopted by the
City Council of the Cit of Newport B ach at a regular meeting
thereof held on the day of 1944, by
the following vote, to -wit:
