1 RESOLUTION NO. (�
2 WHEREAS, one ALBERT B. HOLMES, a single man, offered
3 to the City of Newport Beach the sum of $275.00 for Lot 19,
4 Block 440, Corona Del Mar, in the City of Newport Beach, as
5 shown on a Map recorded in Book 3, pages 41 and 42 of Miscellan-
6 eous Maps, Records of Orange County, California; and
7 WHEREAS, the City of Newport Beach by Resolution No.
8 3004, duly passed and adopted, accepted said offer of Albert B.
9 Holmes, a single man; and
10 WHEREAS, said Albert B. Holmes has only paid on account
11 of the purchase price aforesaid, the sum of $27,50, and has
12 wholly failed, neglected and refused to pay tre balance of
13 $247,50, although demand has been made upon him on numerous
14 occasions to pay the balance due as aforesaid.
15 NOW, THEREFORE, BE IT RESOLVED: That said Resolution
16 No. 3004 aforesaid, be and the same is hereby rescinded and de-
17 clared of no further force or effect for any purpose whatever.
18 BE IT FURTHER RESOLVED: That the sale of said property
19 heretofore mentioned, to the said Albert B. Holmes, be, and the
20 same is hereby cancelled as of this date, and the moneys hereto -
21 fore paid thereon by the said Albert B. Holmes to the City of
22 Newport Beach, are hereby declared to be forefeited to the said
23 City of Newport Beach for the failure of said Albert B. Holmes
24 to pay tie balance of said purchase price aforesaid.

I hereby certify that the above and foregoing resolu-
28 tion was duly and regularly passed and adopted by the City
29 Council of the City of Newport Beach at a regular meeting thereof
30 held on the 2nd day of October 1944,
