TMEREAS, by Resolution 2985 of the City of Newport Beach,

the City Council of the City of Newport Beach authorized the sale
5
of Lot 5, Block 46, Third Addition to Newport Beach as shown on a
6
Map recorded in Book 3, page 31 of Miscellaneous Maps, records of
7
Orange County, California, to ELBERT R. VAKINSON and SYLVIA A.
8
MAKINSON, Husband and Wife, for the sum of $325.00, and
9
WHEREAS, said sale was made subject to the City of
10
Newport Beach being able to give a good and sufficient deed to
11
the property to the purchasers thereof and a policy of title in-
12
surance thereon, and
13
WHEREAS, the City of Newport Beach is unable to sell
14
said property at the present time for the reason that they do not
15
have a merchantable title thereto, and the parties desiring to
16
purchase the same do not wish to wait until the City has perfected
17
title to the said described property, and
18
WHEREAS, the purchasers of said property desire that
19
the moneys heretofore paid on said property be returned to them,
20
and that said proposed sale be cancelled and declared of no fur -
21
ther force or effect.

23 NOW, THERERORE, BE IT RESOLVED: That said Sale to
24 Elbert R. Makinson and Sylvia A. Makinson, Husband and Wife, by
25 the City of Newport Beach, and involving Lot 5, Block 46, Third
26 Addition to Newport Beach as shorn on a Map recorded in Book 3,
27 page 31 of Miscellaneous Maps, records of Orange County, Calif-
, 28 ornia be, and the same is hereby annulled, cancelled and declared
29 of no further force or effect for any purpose whatever, and
30 BE IT FURTHER RESOLVED that the Treasurer of the City
31 of Newport Beach be authorized, instructed and directed to return
32 to said purchasers, Elbert R. Makinson and Sylvia A. Makinson,

all moneys which they have paid on account of said sale, and
BE IT FUR7kiER RESOLVED that said Resolution 2985 of
the City of Newport Beach be, and the same is hereby declared
to have been rescinded and declared of no further force or
effect for any purpose whatever.
I hereby certify that the foregoing Resolution was duly
and regularly passed and adopted by the City Council of the City
of Newport Beach at a regular meeting thereof held on the
day of� . 1944.
