RESOLUTION NO.
WHEREAS, by Resolution No. 3074 of the City of Newport
Beach, the City Council of the City of Newport Beach authorized
the sale of Lots 2 and 3, Block 142, Canal Section, City of
Newport Beach, to RALPH S. ZAUN and SALLY E. ZAUN, Husband and
Wife, for the sum of ;350.00, and
WHEREAS, said sale was made subject to the City of
Newport Beach being able to give a good and sufficient deed to
the property to the purchasers thereof and a policy of title in-
suranoe thereon, and
WHEREAS, the City of Newport Beach is unable to sell
said property at the present time for the reason that they do not
have a merchantable title thereto, and the parties desiring to
purchase the same do not wish to wait until the City has perfected
title to the said described property, and
WHEREAS, the purchasers of said property desire that
the moneys heretofore paid on said property be returned to them,
and that said proposed sale be cancelled and declared of no fur-
ther force or effect.
NOW, THEREFORE, BE IT RESOLVED: That said sale to
Ralph S. Zaun and Sally E. Zaun, Husband and wife, by the City of
Newport Beach, and involving Lots 2 and 3, Block 142, Canal
Section, in the City of'Newport Beach be, and the same is hereby
annulled, cancelled and declared of no further force or effect
for any purpose whatever, and
BE IT FURTHER RESOLVED that the Treasurer of the City of
Newport Beach be authorized, instructed and directed to return to
said purchasers, Ralph S. Zaun and Sally E. Zaun, all moneys which
they have paid on account of said sale, and

BE IT FURTHER RESOLVED that said Resolution No. 3074 of
the City of Newport Beach be, and the same is hereby declared
to have been rescinded and declared of no further force or
effect for any purpose whatever.
I hereby certify that the foregoing Resolution was duly
and regularly passed and adopted by the City Council of thp.City
of Newport Beach at a regular meeting thereof held on the
day of A" i-All % 1944.
