RESOLUTION ORDERING IMPROVELEXT WHEREAS, the City Council of the City of Newport Beach on the Lx�_ day of ��� ;Aka��, 1944, passed its Resolu- tion of Intention No. 3O %0 to order the hereinafter improve- ment to be made and public work to be done in the City of Newport Beach; and WHEREAS, after the passage and adoption of Resolution of Intention No.� , the street Superintendent of the City of Newport Beach caused to be conspictously posted along the line of the contemplated work and improvement at not more than three hundred feet (3001) in distance apart, and in all, notice of the passage of said Resolution of Intention, headed "NOTICE OF PUBLIC WORK", in the manner, form and substance as required by law, and said Street Superintendent also caused a notice similar in substance to be published by inserting said notice for four successive times in the NEWPORT BALBOA NEVIS TIMES, a semi - weekly newspaper published and circulated and of general circulation in the City of Newport Beach, and named by said City in said Resolution of Intention as the paper in which said notice should appear, all as appears from the affidavit of _S-kI154ty of the printers and publishers of said semi - weekly newspaper, and which affidavit was filed in the office of the Clerk of the City of Newport Beach on the 7_ day of �V���i��, 1944, and is now on file therein; and WHEREAS, the Street Superintendent of the City of Newport Beach commenced the posting of the notice hereinbefore referred to on the F{ day of 1944, and fully v -1- ■ f • 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 LAW OFFICES OF POLAND THOMPSON 210 SPAR. SANTA ANA, CALIF. completed the posting thereof on the _4_, day of 1944, as appears from the affidavit of;�.��a�� ,"a-1,stant Street Superintendent of the City of Newport Beach, and more than ten (10) days having expired after the expiration of the time of the publication of said notice within which pro- tests or objections to the proposed work or improvement might be made by any person interest objecting to said work or improvement, or to the extent of the district or lands to be affected or benefited by said work or improvement and to be assessed to pay the costs and expenses thereof; and IMEREAS, no person has filed written or made oral objections to said work or improvement or to the extent of the district or lands to be affected or benefited by said work or improvement, and to be assessed to pay the costs and expenses thereof, or make any written objections whatsoever regarding said work or improvement; and NMEREAS, more than ten days has expired since the pub- lication of said notice of public work heretofore referred to and the City Council of the City of Newport Beach has now acquired jurisdiction to order the said improvement. ALLEYS IN BLOCKS 531 and 631 All that portion of those certain alleys, 14 feet in width in Blocks 531 and 631 as laid out and shown upon a map of Corona Del Yar, recorded in Book 3, Pages 41 and 42 of Miscel- laneous Maps, records of Orange County, Calif- ornia, lying between the prolongation of the northeasterly line of 2nd Avenue (formerly 54th Place) and the prolongation of the south- westerly line of 4th Avenue (formerly 56th Place), as laid out and shown upon said map of Corona Del Mar, recorded in Book 3, Pages 41 and 42 of Miscellaneous Maps, Records of Orange County, California. J All of which is more clearly shown on a certain map approved and adopted by the City Council of the City of Newport Beach for said abandonment by Resolution No. 3 0'Iq_, on the oo4-__ day of 1944. �f That the public work and improvement to be made is for the purpose of closing up and abandoning portions of a.o6rtain street and certain alleys in the City of Newport Beach as herein- after described, and for that reason no district is chargeable for costs in connection therewith. All of the herein proposed work shall be done in pur- suance of an Act of the Legislature of the State of California, known as the Street Opening Act of 1889, approved April 4, 1941, Statutes 1941, Chapter 79, Division 5, Part 1, Streets and High- ways Code. For further particulars reference is hereby made to said Resolution of Intention No.,' 16ji) , which is dated the day of 0tro;�VA , 1944, and on file with the Clerk of the City of Newport Beach.
