WHEREAS, there has been presented to the City Council of the City of Newport Beach, California, a Petition requesting the annexation of the territory hereinafter described to the City of Newport Beach; NOW THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, as follows: I. That it is proposed to annex to the City of Newport Beach, California, that certain territory contiguous to the City boundaries, which territory is more particularly described on °EXHIBIT A", annexed hereto and by reference made a part here- of. 2. That said territory lies adjacent to the City boundary line extending along West Newport Channel southerly of State Highway ORA 60-A, and westerly of State Highway ORA 43 -A, and said territory comprises approximately 16.11 acres. 3. That notice is further hereby given that the �� day of _ 1946, at the hour of �,+ of said day, in the Council Chambers in the City Hall,, in the City of Newport Beach, is the time and place when and where any person owning real property within said territory so proposed to be annexed and having any objections to the proposed annexation, may appear before the City Council and show cause why such territory should not be Iso annexed 4.• That upon such annexation, the City shall: (a) Approve said subdivision and plan of development as set h,'subject to the recommendation of the Planning Commission. o (b) Within a reasonable time from the date of annexation, City will extend the City's water line to the boundary of the -1- 1 • 2 3 • 4 5 6 7 8 9 • AS 10 11 12 13 14 15 16 17 18. 19 20 21 22 23 24 25 26 27 28 29 30 31 32 proposed annexation, in order that connection therewith may be made by the subdivider for the supplying of water to said sub- division. (c) The City shall not levy nor .assess any taxes against the annexed territory to pay for any present outstanding bonded debt of said City of Newport Beach. (d) Zone said annexed property as indicated on the attach- ed tentative map, subject to the recommendation of the Planning Commission. The City Clerk shall cause a copy of the foregoing Resolu- tion to be published at least once a week for two successive weeks in the Newport Balboa News— Times, a newspaper of general circulation published in the City of Newport Beach, California. R H T, City Clerk B b. —2— I • 2 3 • 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 • 28 . 29 30 31 32 All that certain land situated in the County of Orange, State of California, being contiguous to the boundaries of the City of Newport Beach and described as follows: Beginning at the point of intersection of the southerly line of State Highway ORA 60 A produced easterly, said line measured 40 feet a$ right angles from the center line of said State Highway, with the southerly prolongation of the easterly line of Newport Beach Boulevard, said easterly line being the existing boundary line of the City of Newport Beach; thence, from this point of be- ginning along said southerly line of State Highway to the easterly line of State Highway ORA 43-A; thence, south- erly along said easterly line to a point in the southerly line of the 100 foot right of way of State Highway ORA 60 -A, said line being tangent to a curve having a radius of 1550 feet; thence, westerly through said curve, having an angle of 120 46, to a point in a line, said line being tangent to aforesaid curve; thence, westerly along said tangent to its point of tangency with a curve, having a radius of 1550 feet; thence, westerly from said point of tangency along said curve, a d�stance of 60.21 feet; thence, South 9 27' West 339.42 feet, more or less, to its intersection with a line designa- ted as "North Line ", being the mean high tide line as per Superior Court Case No. 23686, Book 201, Page 253 of Official Records of Orange County, said point being.distant easterly 83.55 feet from the intersection of a line having a bearing of North 370 15' 30" West with a line having a bearing of North 730 34' 20" West; thence, easterly along said mean high tide line to its intersection with the westerly line of Central Avenue, said westerly line being the existing boundary line of the City of Newport Beach; thence, northerly along said boundary line through its various courses to the point of beginning.
