RESOLUTION NO,�OI�
WHEREAS, the City of Newport Beach is the owner of Lot
31116 in Block 35 of Newport Beach, as shown on a Map recorded in Book
4113, page 26 of Miscellaneous Maps, records of Orange County, Cali-
5 11 fornia; and
6 WHEREAS, T. R. Benjamin and Christine Benjamin, husband
7 and wife, are the owners of Lot 2 in Block 135 of Lake Tract, New -
8 port Beach, as shown on a Map recorded in Book 4, page 13 of Mis-
9 cellaneous Maps, records of Orange County, California; and
10 WHEREAS, the City is in urgent need of the property owned
11 by T. R. Benjamin and Christine Benjamin, husband and wife, hereto -
12 fore described, for•the widening of Coast Boulevard in said City;
13 and
14 WHEREAS, the properties above - mentioned are of approxima
15 ly equal market value; and
16 WHEREAS, the City has agreed to exchange the property
17 owned by it for the property owned by said T. R. Benjamin and
18 '!Christine Benjamin, husband and wife; and
19 WHEREAS, in the judgment of the City Council of the City
20110f Newport Beach, the consideration for said exchange is fair,
21 just, and adequate, as the properties are of approximately equal
22 market value; and
23 WHEREAS, it is for the best interests and benefit of the
24 City of Newport Beach and the inhabitants thereof that said exchan
25 11 be made;
26 NOW, THEREFORE, BE IT RESOLVED that the City of Newport
27 Beach make, execute, and deliver to T. R. Benjamin and Christine
28 Benjamin, Husband and ?life, a deed to the properties heretofore
29 described as being owned by it, in exchange for a good and suffi-
30 cient deed to the properties owned by said T-. R. Benjamin and
31 Christine Benjamin, husband and wife;
32 AND BE IT FURTHER RESOLVED that all escrow charges and

1 charges of title be at the expense of said City, and that both
• 2 properties herein mentioned and described shall be conveyed to the
3 parties hereto, free and clear of all encumbrances of every
4 nature, description, or kind.
5 AND BE IT FURTHER RESOLVED that the Mayor and City Clerk
6 of the City of Newport Beach, be authorized, directed and instruc-
7 ted to sign and execute, on behalf of the City of Newport Beach
8 and in the name of said City, a corporation grant deed, granting
9 to the said.T. R. Benjamin and Christine Benjamin, husband and wife
10 the properties owned by said City and heretofore described, and
11 that said deed be delivered to said T. R. Benjamin and Christine
12 Benjamin, husband and wife, when said named parties have made,
13 executed, and delivered a good and sufficient deed to the propertie
14 owned by them, to the City of Newport Beach.

16 I hereby certify that the above and foregoing Resolution
17 was duly and regularly passed and adopted by the City Council of
18 the City of Newport Beach at a regular meeting thereof held on the
19 15th day of July, 1946, by the following vote, t -wit:

regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
the 15th day of July , 1946, by the following
