HomeMy WebLinkAbout3356 - Widening of Coast Boulevardf., S 1 RESOLUTION NO. • 2 WHEREAS, the City of Newport Beach is the owner of Lot 3 16 in Blook 39 of River Section, Newport Beach, as shown on a map 4 recorded ih Book 4, page 25 of Miscellaneous Maps, records of 5 Orange County, California; and 6 111'HEREAS, Walter R. Bonner and Vernieoe Bonner, husband 7 and wife, are the owners of Lot 1 in Blook 140 of Canal Section, 8 Newport Beaoh, as shown on a Map recorded in Book 4, page 98 of 9 Miscellaneous Maps, records of Orange County, California; and 10 WHEREAS, the City is in urgent need of the property 11 owned by Walter R. Bonner and Verniece Bonner, husband and wife, 12 heretofore described, for the widening of Coast Boulevard in said 13 City; and 14 WHEREAS, the properties above - mentioned are of approxima 15 ly equal market value; and 16 WHEREAS, the City has agreed to exchange the property 17 owned by it for the property owned by said Walter R. Bonner and 1 18 Verniece Bonner, husband,�nd wife; and 19 WHEREAS, in the judgment of the City Council of the City 20 Newport Beach, the consideration for said exchange is fair, just, 21 and adequate, as the properties are of approximately equal market 22 value; and 23 WHEREAS, it is for the best interests and benefit of the 24 City of Newport Beach and the inhabitants thereof that said ex- 25 change be made; 2611 NOW, THEREFORE, BE IT RESOLVED that the City of Newport 27 Beach make, execute, and deliver to Walter R. Bonner and Verniece • 28 Bonner, husband and wife, a deed to the properties heretofore ANNE 29 described as being owned by it, in exchange for a good and suffi- 30 oient deed to the properties owned by said Walter R. CALIF., W c -_r' charges of title be at the expense of said City, and that both properties herein mentioned and described Bhall be conveyed to the parties hereto, free and clear of all encumbrances of every nature, description, or kind. AND BE IT FURTIER RESOLVED that the Mayor and City Clerk of the City of Newport Beach, be authorized, directed and instruc- ted to sign and execute, on behalf of the City of Newport Beach and in the name of said City, a corporation grant deed, granting to the said Walter R. Bonner and Verniece Bonner, husband and wife, the properties owned by said City and heretofore described, and that said deed be delivered to said Walter R. Bonner and Verniece Bonner, husband and wife, when said named parties have made, exe- cuted, and delivered a good and sufficient deed to the properties owned by them, to the City of Newport Beach.
