1 RESOLUTION NO
02° WHEREAS, there is now pending in the Superior Court of
3 the State of California, in and for the County of Orange, Aotion
4 No. 46416 , involving that oertain real property situated in the
5 City of Newport Heaoh, County of Orange, State of California, and
6 more partioularly desoribed as follows, to-wit:
7 Lot Two (2) in Hlook Four Hundred Thirty -three (433)
$ "Canal Seotion, Newport Heaoh ", as shown on a map
reoorded in Hook 4, page 98 of Misoellaneous Maps,
9 reoords of Orange County, California.
and

11 WHEREAS, the defendants in said aotion are the reoord
12 owners of said real property, and also own a bond now a lien on
said real property and issued under and pursuant to the Improvement
13
14 *ct of 1911, being bond No. 239;.and
15 WHEREAS, the City of Newport Heaoh has been offered, for
16 all of its right, title and interest in and to said real property,
17 the sum of $1,000; and
18 WHEREAS, the City Counoil of the City of Newport Heaoh
19 deems that said prioe is just, fair and adequate for the interest
20 whioh said City may have in said property, and that it will be for
21 the best interests and benefit of said oity that said oity dispose
22 of its right, title and interest in said property in order that said
23 property may again be plaoed on the assessment rolls where it will
24 bear its just burden of taxation.
25 NOW, THEREFORE, HE IT RESOLVED: That a oertain stipula-
26 Ition entered into by and between the plaintiff in said aotion and
27 the defendants therein, wherein and whereby said defendants agree
28 to pay to said oity the sum of $1,000, and in addition thereto, to
29 pay to Roland Thompson, attorney for the City of Newport Heaoh, and
30 attorney for the plaintiff in the above- entitled aotion, fees due
31 from said City to said attorney in the sum of #100 for servioes
32 rendered in this aotion and to be rendered therein; and that title

be quieted -in them on their oross- oomplaint, subject, however, to
'the matters in said stipulation mentioned, a copy of which said
stipulation is on file with the City Clerk of the City of Newport
Beach, be and the same is hereby approved, and the Mayor and City
Clerk of the City of Newport Beach are authorized, directed and
instructed to approve in writing the Stipulation this day presented
to the City Council of the City of Newport Beach, on behalf of
said City of Newport Beach.
I hereby certify that the above and foregoing Resolution
was duly and regularly passed and adgpted by the City Council of
the City of Newport Beach at e00 3Qular meeting thereof held on the
,day of July, 1946, by the following vote, to -wit:
