RESOLUTION NO. I VL�
WHEREAS, the City of Newport Beaoh.is the owner of Lot
6 in Block 235 of Lake Tract, Newport Beach, as shown on a Map
recorded in Book 4, page 13 of Miscellaneous Maps, records of
Orange County, California; and
WHEREAS, Mabel E. Yoerk, a married woman, is the owner of
the Northwesterly rectangular 32* feet of Lots 21, 22 and 23 of
Block 133, Lake Tract, Newport Beach, as shown on a Map recorded in
Book 4, page 13 of Miscellaneous Maps, records of Orange County,
California; and
WHEREAS, the City is in urge it need of the property owned
by Mabel E. Yoerk, a married woman, heretofore described, for the
widening of Coast Boulevard in said City; and
WHEREAS, the properties above - mentioned, are of approximately equal
market value, except that the properties owned by Mabel E. Yoerk,
a married woman, are worth approximately #437.50 more than the
City -owned property; and
WHEREAS, the City has agreed to exchange the property
owned by it for the property owned by said Mabel E. Yoerk, a
married women, and has further agreed to pay the difference in
equities amounting to the sum of $437.50; and
WHEREAS, in the judgment of the City Council of the City
of Newport Beach, the consideration for said exchange is fair,
just, and adequate, as the money and property given by the City is
of approximately.equal market value to the property which it is
Ito receive; and
WHEREAS, it is for the best interests and benefit of the
City of Newport Beach and the inhabitants thereof that said exchange
be made;
NOW, THEREFORE, BE IT RESOLVED that the City of Newport
Beach make, execute, and deliver to Mabel E. Yoerk, a married
woman, a deed to the properties heretofore described as being owned

1 11by it, in exchange for a good and sufficient deed to the properties
• 2 owned by said Mabel E. Yoerk, a married woman;
AND BE IT FURTHER RESOLVED that all excrow charges and
• 4 Ilcharges of title be divided equally between the parties herein, and
511that both properties herein mentioned and described shall be con-
6 veyed to the parties hereto, free and clear of all encumbrances of
7 every nature, description, or kind.
8 AND BE IT FURTHER RESOLVED that the Mayor and City Clerk
9 of the City of Newport Beach, be authorized, directed and instruct
10 to sign and execute, on behalf of the City of Newport Beach and in
11 the name of said City, a corporation grant deed, granting to the
12 said Mabel E. Yoerk, a married woman, the properties owned by said
13 City and heretofore described, and that said deed be delivered to
14 said Mabel E. Yoerk, a married woman, when said named party has
15 made, executed, and delivered a good and sufficient deed to the pr
16 perties owned by her, to the City of Newport Beach.

I hereby certify that the above and foregoing Resolution

was duly and regularly passed and adopted by the City Council of
19
the City of Newport Beach at a regular meeting thereof held on the
20
19th day of August, 1946, by the following vote, t t:

the foregoing Resolution No. 3378 was duly and
regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
the 19th day of August , 1946, by the following
