3 WHEREAS, the City of Newport Beach is the owner of Lot
Ak
4 15 in Block 43 of River Section, Newport Beach, as shown on a Map
5 recorded in Book 4, page 25 of Miscellaneous Maps, records of
6
Orange
County, California;
and
7
of Newport Beach, the consideration for said
WHEREAS, CLARA J.
SCHROEDER, a single woman, is the owner
8
of Lot
13 in Block 141 of
Canal Section, Newport Beach, as shown on
9
a Map
recorded in Book 4,
page 25 of Miscellaneous Maps, records of
10
Orange
County, California;
and
11
WHEREAS, the City
is in urgent need of the property owned
12 11 by Clara J. Schroeder, a single woman, heretofore described, for
13 the widening of Coast Boulevard in said City; and
14 WHEREAS, the properties above - mentioned of Clara J.
15 Schroeder are worth approximately $232.50 more than the above -
16 mentioned properties of the City of Newport Beach; and
17 WHEREAS, the City has agreed to exchange the property
18 owned by it for the property owned by the said Clara J. Schroeder,
19 a single woman, and has further agreed to pay to the said Clara J.
20 Schroeder the sum of $232.50, and the said Clara J. Schroeder has
21 agreed to accept the said sum of $232.50 for proposed costs in
22 installing the following improvements: paving street, $75; paving
2311 curb, $45; paving sidewalk, $37.50; and sewer $75; and

WHEREAS, in the judgment of the City
Council
of the City
25
of Newport Beach, the consideration for said
exchange
is fair,
26
just, and adequate, as the property and money
given by
the City
27
is of approximately equal market value to the
property
which it is
• 28 to receive; and
29 WHEREAS, it is for the best interests and benefit of the
30 City of Newport Beach and the inhabitants thereof that said excha
31 be made;
32 NOW, THEREFORE, BE IT RESOLVED that the City of Newport

Beach make, execute, and deliver to Clara'J. Schroeder a deed to
properties heretofore described as being owned by it, in exchange
for a good and sufficient deed to the properties owned by the said
Clara J. Schroeder, and that the City of Newport Beach pay to the
said Clara J. Schroeder the sum of $232.50, which the said Clara J.
Schroeder agrees to accept for proposed costs in installing the fol
lowing improvements: paving street, $75; paving curb, $45; paving
sidewalk, $37.50; and sewer, $75.
AND BE IT FURTHER RESOLVED that all escrow charges and
charges of title be at the expense of said City, and that both pro-
parties herein mentioned and described shall be conveyed to the
ties hereto free and clear of all encumbrances of every nature,
description or kind.
AND BE IT FURTHER RESOLVED that the Mayor'and City Clerk
of the City of Newport Beach be authorized, directed and instructed
to sign and execute, on behalf of the City of Newport Beach and in
the name of said City, a corporation grant deed, granting to the
said Clara J. Schroeder, a single woman, the properties owned by
said city and heretofore described, and that said deed be delivered
to the said Clara J. Schroeder, when said named party has made,
executed, and delivered a good and sufficient deed to the propertie
owned by her to the City of Newport Beach.
I hereby certify that the above and foregoing Resolution
was duly and regularly passed and adopted by the City Council of
the City of New ort Beach at aYregular meeting thereof held on the
-dday of 1946, by the following vote, to -wit:
