HomeMy WebLinkAbout3473 - Vacating Certain Alleys in CdM• C II RESOLUTION OF '.J' INTENTION NO 4 1') 2 - 3 A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF NDVPORT BEACH DECLARING ITS 4 INTENTION TO ORDER THE CLOSING UP, VACATION, AND ABANDONMENT OF PORTIONS OF CERTAIN ALLEYS 5 IN THE CORONA DEL MAR DISTRICT, CITY OF NEWPORT BEACH, COUNTY OF ORANGE, STATE OF CALIFORNIA. 6 7 8 The City Council of the City of Newport Beach, pur- 9 suant to the provisions of the "Street Vacation Act of 1941 ", 10 approved May 13, 1941, Statutes 1941, Chapter 250 and amendments 11 thereto, being Division 9, Page 3, Chapters 2 and 3; Sections 12 8320 to 8331, inclusive, Streets and Highways Code, does hereby 13 ordain, resolve, and declare as follows: 14 Section 1: That the public interest and convenience 15 require the closing up and abandonment of portions of certain 16 alleys in the Corona Del Mar District, in the City of Newport 17 Beach, and it is the intention of the City Council of the City 18 of Newport Beach to order the following described alleys in 19 said Corona Del Mar District, in the City of Newport Beach, 20 County of Orange, Stake of California, to be vacated, closed up 21 and abandoned, towit: 22 All of that alley 14 feet in width and that alley 12 feet in width in Block A -37, as shown upon a map of 23 Corona Del 4har recorded in 1.Iiscellaneous Idap Book 3, Pages 41 and 42, records of Orange County, California, 24 and more particularly described as follows: 25 Beginning at the most northerly corner of Lot 8, of sc1 d Block A -37, thence northeasterly on a direct 26 line to the most westerly corner of Lot 10 of said Block, thence southeasterly along the southwesterly 27 line of said Lot 10, to the most southerly corner thereof, thence Northeasterly along the southeasterly line of Lots 28 10, 12, 14 and 16 of said Block to the most easterly•.cor- ner of Lot of said Lot 16, thence on a direct line to the 29 most northerly corner of Lot 15 of said Block, thence 30 Southwesterly along the northwesterly line of Lots 15, 13, 11 and 9 to the most westerly corner of said Lot 9, 31 thence southeasterly along the southwesterly line of said Lot 9 to the most southerly corner thereof, thence 32 southwesterly on a direct line to the most easterly cor- ner of Lot 1 of said Block, thence northwesterly along LAW OFFICEN OF -1- HOLAND TNOMPSON 200 SPURG.EON BLDG. All portions of said alleys to be vacated, closed up, and abandoned, are more clearly shown on a certain map approved and adopted by the City Council of the City of Newport Beach for said vacation, closing up and abandonment, by Resolution dated April 28, 1947, and designated "Resolution No. , Reference is hereby made for further particulars as to the proposed vaca- tion, closing up, and abandonment of said portions of said alleys, to said map, and said map is made a part of this Resolution to the same extent and purpose as if the same were herein incorpor- ated in. full. Section 2: That the proceedings for the closing up and abandonment of the aforesaid portions of said alleys shall be had and taken, and the City Council of the City of New;.)ort 3each elects to proceed under the provisions of the "Street Vacation Act of 194111, a roved May 13, 1941, Statutes 1941, Chanter 250, and amendments thereto, being Division 9, P�.-e 3, Chapters 2 and 3, Sections 8320 to 8331, inclusive, Streets and Highways Code. Section 3: The Street Superintendent of the City of Newport Beach shall cause to be conspicuously posted alon„ the line of the portions of the alleys proposed to be vacated, not more than 300 feet apert, but not less than three in all, notices of the vacation of said portions of said alleys. Said notices shall stake the passab-e of this Resolution of Intention and the time and place of the hearing; of all persons interested in or objecting; to the proposed vacation of said portions of said alleys, all as required by law. Section 4: Notice is hereby given that the City Council of the City of Newport Beach does hereby fix i:onday,the 9th day O of June, 1947, at the hour of four o'clock P.E. of saki day, in the Council Chambers of the City of Newport Beach, located in LAW OFFICES OF -2- ROLAND THOMPSON 205 SFURGEON SLOG, SANTA ANA. And the said City Coun- cil, at said time and place, will hear the evidence offered by any person interested in the vacation of said portions of said alleys heretofore described. Section 5: This Resolution of Intention shall be published at least once in the Newport- Balboa Press, a newspaper of general circulation printed, published and circulated in the City of Newport Beach, and said publication shall be made before the date set for the hearing of all persons interested in or ob- jecting to the proposed vacation.
