HomeMy WebLinkAbout3492 - Vacating Portions of Alleys in CdM0 t 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 RESOLUTION NOAML RESOMPTON ORDERING VACATION WHEREAS? the City of Newport Beach, on the 29th day of April, 1947, passed its certain Resolution of Intention No. 3473, deolaring its intention to order the olosin up, vacation and donment of portions of certain alleys in the Corona Del Mar dis- triot in the City of Newport Beach, pursuant to and in accordance with the "Street Vacation Act of 19410, approved Nay 13, 1941s Statutes 1941, Chanter 260 and canondments thereto, being Division 91 Text 31 Chapters 2 and 3, Sections 8320 to 6331, inaluaive, Streets and Hirghnays Code; end ITHEREAS, the Street Superintendent of the City of PevmOrt Beach has caused to be conspicuously posted along the line of said alleys, not more than 300 foot apart, and not less than three in all, notices of the vacation of said portions of said alleys, all of which will more fully appear from the affidavit of L. W. Covort, the Street Superintendent of said City of Newport Beach, on file in these proceedings; and WHEREAS, said notices so postod by the Street Superintendent of the City of Newport Beach, stated the passage of said Resolutio of Intention No. 3473, aforesaid, and the date and place of the hearing of all persons interested in or objecting to tho proposed vacation of said Portions of said alleys, and WREREASP the City Council of the City of Necmport Beach by said Resolution of Intention aforesaid, did fix Monday, the 9th day of June, 1947, at the hour of 4 o1olook P. 11. of said day, In the Council Chambers of the City Council of the City of Newport Beach, located in the City Hall of the City of Newport Beach, as the time and place for the hearing of all persons interested in or objecting to the proposed vacation of said portions of said alleys; and LAW OP.ICE6 OP 1 "LA" "OMPSON 'LOB SPU6OEON BLDG. M. in the Council Chtrnbers of the City Council of the City of Fewport Beach, located in the City mall of the City of Herport Beach; and WHEREAS, the hearing of all persons interested in or object- ing to the proposed vacation of said portions of said alleys was legally hold by the City Council of tho City of Newport Beach at the hour of 4 o'clock P. M. on Lionday, the 23rd day of June, 1947, at the Council Chambers of the City Council of tho City of Newport Beech, located in the City Hall of the City of Hc7port Beach; and WHEREAS, said Resolution of Intention No. 34:73 aforesaid, has been published at least once in the Newport Balboa Press, a enewspaper of general circulation printed, published and circulated in the City of Newport Beach, and said publication was made more than fifteen days before the date set for the hearing of all per- sons interested An or objecting; to the proposed vacation, all of which will more fully appear by the affidavit of Ben Reddiek, printer and publisher of said Idenport Balboa Press, on file in these proceedings; and WHEREAS, the City Council has hoard tale evidence, both written and verbal, by all porsonsinterested inthe vacation of said portions of said alleys in this Resolution more particularly hereinafter described, and finds from all the evidence submitted that said portions of said alloys described in the Resolution of Intention, and hereinafter desoribed, are unnecessary for present or prospective alley purposes; NOW THEREFORE, the City Council of the City of Newport Beach finds and determines and hereby orders: That the following de- scribed portions of certain alleys in the City of Newport Beach, described as follows: LAW OFF1098 OF "LAND TMOMP$.. CALIF, 0 t 1 PORTIONS OF ALLEYS TO BE VACATED: 2 Those certain portions of alleys in Corona Del 3 Mar District, in the City of Newport Beach, County of Orange, State of California, more particularly de- 4 scribed as follows, to -wit: 5 All of that alley 14 feet in width and that alley 12 feet In width in Block A-37, as shown upon a map of 6 Corona del Mar recorded in Miscellaneous Plops Book 3, Pages 41 and 42, records of Orange County, California, 7 and more particularly described as follows: 8 Beginning at the most northerly corner of Lot 8, of said Block A-37, thence northeasterly on a direct 9 line to the most westerly corner of Lot 10 of said Block, thence southeasterly along the southwesterly 10 line of said Lot 10, to the most southerly corner thereof, thence Nortireasterly along the southeasterly 11 line of Lots 10, 120 14 and 16 of said Block to the most easterly corner of said Lot 16, thence on a direct 12 line to the most northerly corner of Lot 15 of said Block, thence Southwesterly along the northwesterly line 13 of Lots 150 13, 11 and 9 to the most westerly corner of said Lot 9, thenoe southeasterly along the southwesterly 14 line of said Lot 9 to the most southerly corner thereof, thence southwesterly on a direct line to the most 15 easterly corner of Lot 1 of said Block, thence north- westerly along the northeasterly line of Lots 1, 2, 31 16 4, 5, 6, 7 and 8 to the point of beginning. 17 are unnecessary for present or prospective public alley purposes, 18 and now makes its order vacating said portions of said alleys de- 19 20 21 22 23 24 25 26 27 28 29 30 31 32 LAW OFFICE.
