WHEREAS, Griffith Company, a California corporation with
4
its principal place of business at and in the City of Los Angeles,
5
County of Los Angeles, State of California, having applied to the
6
City Council of the City of Newport Beach for a permit, granting
7
to it the privilege, right and franchise of erecting a portion of
8
a certain building proposed to be erected and constructed by them
9
on City -owned tideland adjacent to real property owned by said
10
Griffith Company, and
11
WHEREAS said application being in form required by the
12
ordinances, rules and regulations of the City of Newport Beach, and
13
WHEREAS it is the opinion and judgment of the City Council
14
of the.City of Newport Beach that the granting of said permit would
15
be for the best interest and benefit of the City of Newport Beach
16
and the residents and property owners thereof, and
17
W11EREAS it is further the opinion of and judgment of the
18
City Council of the City of Newport Beach that the granting of said
19
permit is for purposes which will not interfere with commerce or
20
navigation and are not inconsistent with the trust upon which said
21
lands are held by the State of California or with the commerce or
22
navigation at said harbor, and
23
WHEREAS the erection and construction of said building
24
will add greatly to the taxes of the City of Newport Beach and will
25
in all respects add to property values of all property in the City
26
of Newport Beach; that all permit fees and other fees provided for
27
by law have been paid by the said Griffith Company and it is the

opinion and judgment of the City Council that the consideration
29
offered for said permit is in all respects fair, just and adequate,
30
and

VdiEREAS the resolution and permit issued pursuant thereto
32
on July 28, 1947, approving the said application of Griffith

Company may have been defective by reason of incomplete description
of the property involved,
NOW, THEREFORE,
BE IT RESOLVED that the City Council of the City of Newport
Beach grant to said Griffith Company the exclusive and irrevocable
right, privilege and franchise for a period of twenty -five years
from the date hereof to erect, construct and maintain the portion
of the building which they propose to erect in, into and over the
waters adjacent to and northeasterly of Lot 1, Tract 1117 of the
City of Newport Beach to a point not to exceed 65 feet from the
bulkhead line (being the northerly boundary line of said Lot 1,
Tract 1117) measured by a line drawn at right angles from said
bulkhead line into the waters of Newport Harbor.
BE IT FQRTH✓R RESOLVED that the Mayor and City Clerk be
authorized, directed and instructed to execute in duplicate an
amended permit in the form this day presented to the City Council
granting the privilege, right and franchise mentioned in the pre-
vious paragraph to the Griffith Company, and that one executed copy
be delivered by the Clerk to Griffith Company and the other copy
be filed in the office of the City Clerk of Newport Beach.
I HEREBY CERTIFY that the above and foregoing resolution
was duly and regularly passed and adopted by the City Council of the
�City of Newport Beach at a regular meeting thereof held on the
