RESOLUTION NO 3 :il-
WHEREAS, there has this day been presented to the City
Council of the City of Newport Beach a certain agreement dated
r
the 27th day of October, 1947, between the City of Newport Beach,
therein referred to as "City ", and Charles C. Fipps, of Newport
Beach, California, therein referred to as "Contractor "; and
WHEREAS, said Agreement provides that the City has awarded
to the Contractor the contract for the furnishing of all required
labor, materials, transportation, tools and equipment necessary
to complete the work of improvement mentioned in plans and speci-
fications attached to said Agreement, for the prices set forth in
the Contractor's Proposal on file in the office of the City Clerk;
and
WHEREAS, said agreement specifically sets forth the terms,
conditions and prices for the doing of said work; and
WHEREAS, the City Council of the City of Newport Beach deems
that it is for the best 1•nterests of said City that said contract
be executed, and that the work therein specified be done by the
Contractor upon the terms and conditions therein specified;
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City
Clerk of the City of Newport Beach be, and they are hereby directed
authorized and instructed to execute said Agreement on behalf of
the City of Newport Beach, and that a duly executed copy thereof be
delivered by the City Clerk to the Contractor.
I hereby certify that the foregoing Resolution was duly and
regularly passed and adopted by the City Council of the City of
Newport Beach at a regular meeting thereof held on the q" L day
of (Doravy , 1947, by the following vote, to —wit:
