RESOLUTION NO,: 6190
On motion of Councilman ``e.n duly seconded
and carried, the following Resolution was adopted:
WHEREAS, steps are being taken looping toward the formation
of a County Sanitation District pursuant to Chapter 250, Statutes
1923, as amended, under the name and style of County Sanitation
District No. 5; and
WHEREAS, the proposed boundaries of said County Sanitation
District include the hereinafter described portion of the incor-
porated area of the City of Newport Beach, a city of the Sixth
Class; and
WHEREAS, Section 4711 of the Health and Safety Code of the
State of California provides that less than the whole of a City
shall not be included in a County Sanitation District except by
vote of a, majority of the Governing Body of the City; and
WHEREAS, it is the desire of this Body that the hereinafter
described portion of the City of Newport Beach be included within
the boundaries of proposed County Sanitation District No. 5;
NOSY, THEREFORE, BE IT RESOLVED, that this Body consents to
the inclusion of the following described portion of the City of
Newport Beach within the boundaries of proposed County Sanitation
District No. 5. The territory referred to is described as
follows:
PROPOSED COUNTY SANITATION DISTRICT NO. 5
