HomeMy WebLinkAbout3585 - Santa Ana Avenue & Other ImprovementsRESOLUTION N0.�nS RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NE"ORT BEACH, CALIFORNIA, ADOPTED PUR- SUANT TO THE REQUIREMENTS OF THE nSPECIAL ASSESSNrNT INVESTIGATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931s" BEING PART 21 DIVISION IV OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA. WHEREAS, the City Council of the City of Newport Beach, California, having heretofore instructed the City Engineer in -the matter of the proposed improvement of Santa Ana Avenue and other streets and alleys (Newport Heights), to procure the data and pre- pare a written report pursuant to the provisions of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931," being Part 20 Division IV of the Streets and Highways Code of the State of California, and thereafter the said City Engineer presented to this City Council the said written report; and WHEREAS, pursuant to the provisions of said Part 2, Divi- sion IV of the said Streets and Highways Code, the City Council shall, by resolution or ordinance determine in general the nature, location and extent of the proposed improvement; generally define the bound- aries or extent of the district or lands to be specially assessed to pay the cost thereof., or any part of such cost; and determine the Statute under which it is proposed to conduct the proceeding for such improvement, and for the issuance of bonds therein, if any. N091, THEREFORE., BS IT RESOLVED AND DETERMINED BY THE CITY COUNCIL OF THE CITY OF NEIMPORT BEACH, CALIFORNIA, as follows: 1. That the written report presented by the City Engineer for the proposed improvement herein referred to, is hereby approved, and it is hereby ordered that said report be filed in the office of — 1 — E /5 the City Clerk for public inspection. 2. That the proposed improvement herein mentioned is described ass (a) The grading, paving with plant mix material, cnn- struction of cement concrete curbs, gutters, cross- gutters and appurtenant work in connection therewith; in SANTA ANA AVENUE between Fifteenth Street and Cliff Drive; and in SHELTZER AVENUE between Fifteenth Street and Old County Road, southwest and the of Clay Street; and between Beacon Street /produced Sally line of Cliff Drive; and in SAN BERNARDINO AVENUE AND REDLANDS AVENUE between Fifteenth Street and Beacon Street; and in RIVERSIDE AVENUE, TUSTIN AVENUE, EL MODENA AVENUE, ALISO AVENUE, AND IRVINE AVENUE between Fifteenth Street and Cliff Drive; and in FIFTEENTH STREET AND CLAY STREET between Westminister Avenue and Irvine Avenue; and in BROAD STREET - between /Old County Road and Redlands Avenue; and in - 2 - ' BEACON STREET between Tustin Avenue and Irvine Avenue; and in OLD COUNTY ROAD between Broad Street and Rolmwood Drive. (b) The grading, paving with plant mix material, con- struction of cement concrete curbs, gutters, storm drain, catch basin, and appurtenant work in connection therewith; in WESTMINISTER AVENUE between Fifteenth Street and Old County Road at Clay Street, (c) The grading, paving with plant mix material, con- struction of cement concrete curbs, gutters, storm drains, catch basins and appurtenant work in connection therewith; in FULLERTON AVENUE between Fifteenth Street and Cliff Drive; and in BEACON STREET between Smeltzer Avenue and Riverside Avenue; and in CLIFF DRIVE between Smeltzer Avenue and Beacon Street; and between Riverside Avenue and Irvine Avenue (d) The construction of a storm drain and appurtenant work in connection therewith; in a public EASEMENT and extending southwesterly from Cliff Drive, from a - 3 - point midway between Aliso Avenue and Fullerton Avenue to the United States Bulkhead line of Newport Bayp crossing the State Highway. (e) The grading and surfacing with rock and oil and appurtenant work in connection therewith; in the first lying Southeasterly from Westminister Avenue., between Fifteenth Street and Clay Street; and in the first ALLEY lying Southeasterly from Smeltzer Avenue] between Fifteenth Street and the first alley lying southwesterly from Clay Street; and in the first FAR lying Southeasterly from Santa Ana Avenuep between Clay Street and the first alley lying Southwesterly from Clay Street; and between the first alley lying Southwesterly from Broad Street and Beacon Street; and in the first lying Southeasterly from San Bernardino Avenue, between Fifteenth Street and the first alley lying Southwesterly from Clay Street and between the first alley lying South- westerly from Broad Street and the first alley lying Northeasterly from Beacon Street; and in the first FA lying Southeasterly from Eddl.ands Avenuep between Fifteenth - 4 - I1 Street and the first alley lying Northeasterly from Beacon Street; and in the first ALLEY lying Southeasterly from Riverside Avenue, between Fifteenth Street and Clay Street; and in the first ALLEY lying Southeasterly from Tustin Avenue between Fifteenth Street and Beacon Street; and in the first ALLEY lying Southeasterly from E1 Modena Avenue, between Fifteenth Street and the first alley lying Northeasterly from Beacon Street; and in the first ALLEY lying Southeasterly from Aliso Avenue,between Fifteenth Street and the first alley lying Northeasterly from Beacon Street; and in the first ALLEY lying Southeasterly from Fullerton Avenue.9 between Fifteenth Street and the first alley lying Northeasterly from Beacon Street; and in the first ALLEY lying Southwesterly from Clay Street.9 between Smeltzer Avenue and Redlands Avenue; and in the first ALLEY lying Southwesterly from Broad Street, between Santa Ana Avenue and Redlands Avenue; and in the first - 5 - /3� ALLEY lying Northeasterly from Beacon Street, between San Bernardino Avenue and Riverside Avenue; and in the f irst lying Northeasterly from Cliff Drive, between E1 Modena Avenue and Irvine Avenue; and in the first ALLEY lying Northeasterly from Cliff Drive, between Smeltzer Avenue and Santa Ana Avenue; and in the first ALLEY lying Southwesterly from Beacon Street, between Santa Ana Avenue and the first alley lying Nirtherlyfrom Cliff Drive. 3. That all of the said work and improvement proposed to be done, shall be constructed along the lines, between the points and at the places shown on Map No. 420 consisting of four (b) sheets, filed with this report and by this reference made a part of this report. 4. That the district or lands to be specially assessed to pay the costs of said proposed improvement is shown upon Map No. 120 consisting of sheets Nos. 2, 3 and 4, filed with and forming a part of said written report. Reference is hereby made to said Map for a further, full and more complete description of the said assessment district, and the said Map so on file shall govern for all details as to the extent of the said assessment district. 5. That the proposed improvement shall be done under the provisions of the "Improvement Act of 1911," being Division VII of the Streets and Highways Code of the State of California. -b - �J 0 6. That serial bonds bearing interest at the rate of six per cent (6 %) per annum, and extending over a period ending nine (9) years from the second day of January next succeeding the next October fifteenth following their date, shall be issued here- under in the manner provided by the said "Improvement Act of 1911,11 being Part 5 of Division VII of the said Streets and Highways Code to represent each assessment of Twenty —five Dollars ($25.00), or more, remaining unpaid for thirty (30) days after the date of re- cording the assessment warrant. 7. That the said City Council hereby fixes Mondays the °/A day of �aL , 1948, at the hour of four (4t00) o'clock, P.M., as the day and hour and the Council Chamber of the City Council in the City Hall of said City as the place of hearing on the written report of the City Engineer, and hereby orders such hearing to be held by the City Council of said City.
