RESOLUTION NO. - ` ,5
WHEREAS, there has this day been presented to the City
Council of the City of Newport Beach a certain Agreement dated the
_Z0 IL
day of May, 1948; by and between the City of Newport Beach,
a municipal corporation, as party of the first part, and Sully
Miller Cont. Co., a California corporation, as party of the second
part; and
WHEREAS, said Agreement provides that the City has awarded
to the Contractor the contract for the furnishing; of all materials
and all labor in connection with the construction of plant -mixed
surfacing on portion of 32nd Street and other areas adjacent to
the New City Hall in the City of Newport Beach, and to do all the
work required to complete the work of improvement mentioned in
plans and specifications attached to said Agreement, for the prices
set forth in the Contractor's Proposal on file in the office of
the City Engineer of the City of Newport Beach; and
, WHEMS, said Agreement specifically sets forth the terms,
conditions and prices for the doing of said work; and
WHEREAS, the City Council of the City of Newport Beach deems
jthat it is for the best interests of said City that said contract
be executed, and that rhw work therein specified be done by the
Contractor upon the terms and conditions therein specified;
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City
Clerk of the City of Newport Beach be, and and they are hereby
led, authorized and instructed to execute said Agreement on behalf
lof the City of Newport Beach, and that a duly executed copy thereof
Ilbe delivered by the City Clerk to the Contractor.
I hereby certify that the foregoing Resolution was duly and
regularly passed and adopted by the City Council of tho City of
Newport Beach at a - regular meeting thereof
held on the /d74 day of May, 1948, by the following vote, to -wit:
