HomeMy WebLinkAbout3617 - Sewage Pump Station Construction• RESOLUTION OF INTENTION NO. 3 & / RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, DECLARING ITS INTENTION TO ORDER CONSTRUCTION OF SANITARY SEWER PUMPING STATIONS IN CENTRAL AVENUE, IN SAID CITY; DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND DESCRIBING THE DISTRICT TO BE BENEFITED BY SAID WORK AND TO PAY THE COSTS AND EXPENSES AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS TO SAID WORK. The City Council of the City of Newport Beach, pursuant to the provisions of the "Improvement Act of 1911 ", being Division 7 of the Streets and Highways Code of the State of California, does resolve as follows: ih U SECTION 1. That the public interest and convenience require, and it is the intention of the City Council of the City of Newport Beach, California, to order the following work to be done, to -wit: OF WORK First: The construction of vitrified clay pipe sanitary sewer, vitrified clay pipe Wye branches, manholes with cast iron frames and covers, and appurtenant work in connection therewith; in Between the existing manholes on each side of Central Avenue at its. intersection of "B" Street and a point distant 34 feet Northwesterly from the produced center line of that portion of "A" Street, lying Southerly from said Central Avenue, connecting with a sewage pump station to be constructed hereunder; and between the existing manhole at the intersection of 14th Street with said Central Avenue and a point distant 41 feet Northwesterly therefrom, connecting with a sewage pump station to be • constructed hereunder, as shown on Sheet No. 2 of the plans hereinafter • referred to. - 1 - • Second: The construction of vitrified clay pipe sanitary sewer and appurtenant work in connection therewith; in • "A" STREET between Central Avenue and the existing manhole located on the Southeasterly prolongation of the center line of the first alley lying Northeasterly of Central Avenue, as shown on Sheet No. 2 of said plans. Third: The construction of cast iron pipe pressure line and appurtenant work in connection therewith; in CENTRAL AVENUE between points distant 52 feet and 72 feet Northwesterly from the produced center line of that portion of "A" Street, lying Southerly from said Central Ivenue, connecting with an existing manhole and the pump station to be constructed hereunder, as shows on Sheet No. 2 of said plans; and from a point approximately 59 feet Northwesterly frcm the produced center line of 14th Street, thence Northerly 18 feet, connecting with an existing cast iron pipe sewer main and the pump station to be constructed hereunder, as shown on Sheet No. 2 of said plans. Fourth: The construction in Central Avenue, between points distant approximately 34 feet and 52 feet Northwesterly from the produced center line of that portion of "A" Street, lying Southerly of Central Avenue, of a circular reinforced concrete sump and pump chamber, together with the installation of pumps, motors, electrical switchboard, conduits, floats, cast iron pipes, valves, fittings, metal steps, equipment and appurtenances for the lifting or pumping of raw sewage, all as shown on Sheets Nos. 2, 3, 4 and 6 of said plans. • Fifth: The construction in the center parkway of Central • Avenue, between points approximately 41 feet and 59 feet Northwesterly from the produced center line of 14th Street, of a circular r einforced concrete sump and pump chamber, together with the installation of pump, motors, — 2 • electrical switch- board, conduits, floats, cast iron pipes, valves, fittings, metal steps, concrete steps, equipment and appurtenances • for the lifting or pumping of raw sewage, all as shown on Sheets Nos. 2, 5, 6 and 7 of said plans. PLANS, PROFILES, DRAWINGS AND SPECIFICATIONS SECTION 2. All of the said work and improvement to be done, shall be constructed upon the grades, along the lines, between the points, of the dimensions, at the places and in the manner shown on the plans, profiles and drawings for the construction of said improvements in Central Avenue and "A" Street, being Plan No. 423, consisting of 7 sheets, on file in the office of the City Engineer of said City, and except as otherwise provided on said plans in further accordance with the Specifications for the construction of said improve- ments, said specifications being on file in the office of the City Clerk of said City, and to which plans, profiles, drawings and specifications heretofore approved by the City Council of the said City, reference is hereby made for a further, full and more particular description of the said work, and by reference thereto the same are incorporated herein and made a part hereof. DESCRIPTION OF ASSESSMENT DISTRICT SECTION 3. That the said contemplated work and improvement, in the opinion of the said City Council, is of more than local or ordinary public benefit, and the said City Council hereby makes the expenses of the said work and improvement chargeable upon a district, which said district . the said City Council hereby declares to be the district benefited by • said work and improvement and to be assessed to pay the costs and expenses thereof, and which district is described as follows. - 3 - �y • All that certain territory of the City of Newport Beach, • California, exclusive of streets and alleys, included within the exterior boundary line shown upon that certain Map or Plat No. 423-A, heretofore approved by the City Council of said City on the 13th day of September, 1948, indicating by said boundary line the extent of the territory included within the proposed assessment district, and which map or plat is on file in the office of the City Clerk of the said City. Reference is hereby made to said map or plat for a further, full and more particular description of the said assessment district, and the said map or plat so on file shall govern for all details as to the extent of the said assessment district. SECTION 4. That serial bonds shall be issued to represent unpaid assessments and bearing interest at the rate of FIV a per cent (,y %) per annum shall be issued hereunder in the manner provided by the "Improvement Bond Act of 1915 ", being Division 10 of the Streets and Highways Code of the State of California, the last installment of which bonds shall mature Two ( 0-) years from the 2nd day of July next succeeding ten (10) months from their date. Payments on the principal of unpaid assessments and interest thereon shall be made by property owners to the City Treasurer, and the same shall be disbursed by said City Treasurer, all as provided in the "Improvement Xggn of 191$1, hereinafter referred to. TIME AND PLACE OF HEARING SECTION 5. NOTICE IS HEREBY GIVEN, that on the .2 3 to day of October, 1948, at the hour of seven - thirty (7;30) o'clock P.M., • in the Council Chamber of the City Council, in the City Hall of said • City of Newport Beach, any and all persons having any objections to the proposed work or improvement, or to the extent of the assessment district, or to the proposed grades, may appear and show cause why said work should not be done or carried out in accordance with this Resolution of Intention. Protests must be in writing and must be delivered to the City Clerk prior to the time set for the hearing. - 4 - 64 ACT • SECTION 6. That all of the work herein proposed shall be • done and carried through in pursuance of an Act of the Legislature of the State of California, designated the "Improvement Act of 1911 "', being Division 7 of the Streets and Highways Code of the State of California. PUBLICATION OF RESOLUTION OF INTENTION SECTION 7. The "Newport - Balboa Pressn, a weekly newspaper, printed, published and of general circulation in the City of Newport Beach., California, is hereby designated as the newspaper in which this Resolution of Intention shall be published by the City Clerk, in the manner and form provided by law, and for making all other publications in the proceedings under this Resolution of Intention. The City Clerk is directed to mail notices of the adoption of this Resolution of Intention to all persons owning real property proposed to be assessed, whose names and addresses appear on the last equalized assessment roll for City Taxes, all in the manner aid form provided for under Sections 5070, 5194 and 5195 of the said "Improvement Act of 1911 ", of said Streets and Highways Code, POSTING OF NOTICE OF IffROVEMNT SECTION 8. The Superintendent of Streets of the City of Newport Beach, shall cause to be conspicuously posted along the line of said contemplated work or improvement and along all open streets within the district liable to be assessed for said work, notices of the passage of this Resolution of Intention, in the time, form and manner provided by said Code.
