HomeMy WebLinkAbout3628 - Abalone Drive Vacation & Abandonment• Adbk 1W • C 0 P Y I � / / RESOLUTION OF INTENTION NO. 3628 A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING ITS 1 INTENTION TO ORDER THE CLOSING UP, VACATION, AND ABANDONMENT OF A PORTION OF ABALONE DRIVE 2 IN TRACT 742, CITY OF NEWPORT BEACH, COUNTY OF ORANGE, STATE OF CALIFORNIA. 3 4 1 The City Council of the City of Newport Beach, pursuant to 5lthe provisions of the "Street Vacation Act of 1941 ", approved May 6113, 1941, Statutes 1941, Chapter 250 and amendments thereto, being 7 Division 9, Part 3, Chapters 2 and 3, Sections 8320 and 8331, in- 8 clusive, Streets and Highways Code, does hereby ordain, resolve, 9 and declare as follows: 10 SECTION 1: That the public interest and convenience require 11 the closing up and abandonment of a portion of a street in Tract 12 742, in the City of Newport Beach, and it is the intention of the 13lCity Council of the City of Newport Beach to order the following 1 14ldescribed portion of a street in said tract, in the City of Newport 15 Beach, County of Orange, State of California, to be vacated, closed 16 up and abandoned, to -wit: 17 I Beginning at the southeasterly corner of Lot 5, Tract No. 742 as said Tract is shown upon a map recorded in 18 Miscellaneous Maps Book 23, page 42, Records of 19 Orange County, California; thence, easterly on the easterly prolongation of the southerly line of said Lot 5 to an intersection with a line, said line being 20 two feet measured at a right angle easterly of and parallel to the easterly line of Lots 5, 6,7, 8, 9, 10, 11, 12 and 21 13 of said Tract No. 742; 22 thence, northerly along said parallel line to an intersection with the southeasterly prolongation of the 23I northeasterly line of said Lot 13; thence, northwesterly along said southeasterly 24 prolongation to the northeasterly corner of said Lot 25 13: thence, southerly along the easterly line of said 26 Lots 13, 12, 11, 10, 9, 8, 7, 6, and 5 to the point of 27 beginning. 28 All portions of said alley to be vacated, closed up, and 29 abandoned, are more clearly shown on a certain map approved and 30 adopted by the City Council of the City of Newport Beach for said 31 vacation, closing up and abandonment, by Resolution dated September 32 27th, 1948, and designated "Resolution No. 3627 ", Reference is hereby made for further particulars as to the proposed vacation, - 1 - • 1W �J 0 C 0 P Y 1i closing up, and abandonment of said portions of said alley, to said 2 map, and said map is made a part of this Resolution to the same 3 extent and purpose as if the same were herein incorporated in full. 4 SECTION 2: That the proceedings for the closing up and 5 abandonment of the aforesaid portions of said alley shall be had and 6 taken, and the City Council of the City of Newport Beach elects to 7 proceed under the provisions of the "Street Vacation Act of 1941 ", 8 approved May 13, 1941, Statutes 1941, Chapter 250 and amendments 9 thereto, being Division 9, page 3, Chapters 2 and 3, Sections 8320 I 10 to 8331, inclusive, Streets and Highways Code. 11 SECTION 3: The Street Superintendent of the City of Newport 12 j ,Beach shall cause to be conspicuously posted along the line of the 13iportions of the street proposed to be vacated, not more than 300 14 feet apart, but not less than three in all, notices of the vacation 15 of said portions of said street. Said notices shall state the 16 passage of this Resolution of Intention and the time and place of i 17 the hearing of all persons interested in or objecting to the propose 18 vacation of said portions of said street, all as required by law. 19 I SECTION 4: Notice is hereby given that the City Council 20� of the City of Newport Beach does hereby fix Monday, the 22nd day 21 of November, 1948, at the hour of eight o'clock P.M. of said day, 22 in the Council Chambers of the City of Newport Beach, located in 23 the City Hall in the City of Newport Beach, as the time and place 24 Ifor hearing all persons interested in or objecting to the proposed 25 vacation of said portions of said street. And the said City Council 26 at said time and place will hear the evidence offered by any person 27 interested in the vacation of said portions of said street heretofot 28 Idescribed. 29 SECTION 5: This Resolution of Intention shall be publishec 30 at least once in Newport Balboa Press, a newspaper of general cir- 31 Iculation printed, published and circulated in the City of Newport 32 JBeach, and said publication shall be made before the date set for - 2 - • • 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 171 18 I', 19 20 21 22 23 24 25 26 27 28 29 30 31 32 C 0 P Y the hearing of all persons interested in or objecting to the propose vacation. The above and foregoing Resolution of Intention No. 3628 was passed at a regular meeting of the City Council of the City of Newport Beach, held on the 25th day of October, 1948, by the follow- ing vote, to -wit: WA 4t*16 /s/ C.
