HomeMy WebLinkAbout3631 - Sewage Pumping Station Construction• �r 0 0 C 0 P Y 1 RESOLUTION OF INTENTION N0. 3631 2 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, 3 DECLARING ITS INTENTION TO ORDER THE CONSTRUCTION OF, OR REMODELLING OF, 4 SEWAGE PUMPING STATIONS IN SOUTH SPEEDWAY NEAR SAPPHIRE AVENUE AND JADE AVENUE, IN 5 BALBOA ISLAND IN SAID CITY: DECLARING THE WORK TO BE OF MORE THAN LOCAL OR 6 ORDINARY PUBLIC BENEFIT AND DESCRIBING THE DISTRICT TO BE BENEFITED BY SAID WORK 7 AND TO PAY THE COSTS AND EXPENSES AND FIXING A TIME AND PLACE FOR HEARING 8 OBJECTIONS TO SAID WORK. 9I i 10, The City Council of the City of Newport Beach, pursuant 11 Ito the provisions of the "Improvement Act of 1911 ", being Division 12 7 of the Streets and Highways Code of the State of California, does 13 resolve as follows: 14 SECTION 1. That the public interest and convenience require 15 and it is the intention of the City Council of the City of Newport 16 Beach, California, to order the following work to be done, to -wit: 17� DESCRIPTION OF WORK 18 FIRST: The construction, or remodelling, of an existing 19 I sewage pumping station located in the first alley lying North of i 20 i South Bay Front, known as South Speedway (Balboa Island) near 21 J Sapphire Avenue, and the installation of new pumps, motors, electric 22 i appliances, conduits, floats, cast iron pipes, valves fittings, met$ 23 + steps, equipment and appurtenances for the lifting or pumping of raj 24 I sewage, as shown on detailed plans hereinafter referred to. 25 SECOND: The construction, or remodelling, of an existing 26 sewage pumping station located in the first alley lying North of 27 I South Bay Front, known as South Speedway (Balboa Island) near Jade 28 Avenue, and the installation of new pumps, motors, electrical 29 appliances, conduits, floats, cast iron pipes, valves, fittings, 30 metal steps, equipment and appurtenances for the lifting or pumping 31 of raw sewage, as shown on detailed plans hereinafter referred to. 32 - 1 - 0 =r 1' 2' 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 • 28 • 29 30 31 32 C 0 P Y THIRD: The construction and installation of a cast iron sewer pressure line, together with fittings and appurtenances in the first alley lying North of South Bay Front, known as South Soeed� way (Balboa Island), extending from the existing pumping station lass above described, near Jade Avenue, Easterly to the U. S. Bulkhead line of Balboa Island Channel of Newport Bay, as shown on Sheet No. 3 of said plans. FOURTH: The construction and installation of a flexible joint cast iron sewer pipe pressure line, fittings and appurtenances over and across Balboa Island Channel of Newport Bay, between the East and West U. S. Bulkhead lines, connecting with an existing main trunk sewer line at said East Bulkhead line, as shown on Sheet No. 3 of said plans. PLANS, PROFILES, DRAWINGS AND SPECIFICATIONS SECTION 2. All of the said work and improvement to be done, shall be constructed upon the grades, along the lines, between the points, of the dimensions, at the places and in the manner shown on the plans, profiles and drawings for the construction of said improvements in South Speedway of Balboa Island, being Plan No. 424, consisting of 3 sheets, on file in the office of the City Engineer of said City, and except as otherwise provided on said plans, in further accordance with the specifications for the construction of said improvements, said specifications being on file in the office of the City Clerk of said City, and to which plans, profiles, draw- ings and specifications heretofore approved by the City Council of the said City, reference is hereby made for a further, full and more particular description of the said work, and by reference thereto the same are incorporated herein and made a part hereof. DESCRIPTION OF ASSESSMENT DISTRICT SECTION 3. That the said contemplated work and improvement, in the opinion of the said City Council, is of more than local or ordinary public benefit, and the said City Council hereby makes the - 2 - 3- 0 J 1 2 3 4 5 6 7 8 9 10 11 12 13 141 15 16 17 18 19 20' 21 22 23 24 25 26 27 • 28 • 29 30 31 32 COPY expenses of the said work and improvement chargeable upon a district which said district the said City Council hereby declares to be the district benefited by said work and improvement and to be assessed to pay the costs and expenses thereof, and which district is describ as follows: All that certain territory of the City of Newport Beach, California, exclusive of streets and alleys, of Balboa Island, included within the exterior boundary line shown upon that certain Map or Plat No. 424 -A, heretofore approved by the City Council of said City on the 25th day of October, 1948, indicating by said boundary line the extent of the territory included within the pro- posed assessment district, and which Map or Plat is on file in the office of the City Clerk and City Engineer, of the said City. Reference is hereby made to said Map or Plat for a further, full and more particular description of the said assessment district,. and the said map or plat so on file shall govern for all details as to the extent of the said assessment district. DESCRIPTION OF BONDS SECTION 4. That serial bonds, representing unpaid assess- Iments and bearing interest at the rate of five per cent (5 %) per annum, shall be issued hereunder in the manner provided by the "Improvement Bond Act of 1915 ", being Division 10 of the Streets and Highways Code of the State of California, the last installment of which bonds shall mature two (2) years from the second day of J next succeeding ten (10) months from their date. TIME AND PLACE OF HEARING SECTION 5. NOTICE IS HEREBY GIVEN, that on the 2nd day of November, 1948, at the hour of eight (8:00) o'clock P.M., in the Council Chamber of the City Council, in the City Hall of said City of Newport Beach, any and all persons having any objections to the proposed work or improvement, or to the extent of the assessment district, or to the proposed grades, may appear and show cause why - 3 - 11 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16! 17 18 19 20 21 22 23 24 25 26 27 • 28 • 29 30 31 32 said work should not be done or carried out in accordance with this Resolution of Intention. Protests must be in writing and must be delivered to the City Clerk prior to the time set for the hearing. IMPROVEMENT ACT SECTION 6. That all of the work herein proposed shall be done and carried through in pursuance of an Act of the Legislature of the State of California, designated the "Improvement Act of 1911" I being Division 7 of the Streets and Highways Code of the State of California. PUBLICATION OF RESOLUTION OF INTENTION SECTION 7. The "Newport Balboa Press ", a weekly newspaper, printed, published and of general circulation in the City of Newport Beach, California, is hereby designated as the newspaper in which this Resolution of Intention shall be published by the City Clerk, in the manner and form provided by law, and for making all other publications in the proceedings under this Resolution of Intention. The City Clerk is directed to mail notices of the adoption lof this Resolution of Intention to all persons owning real property jproposed to be assessed, whose names and addresses appear on the las lequalized assessment roll for City Taxes, all in the manner and form 1provided for under Sections 5070, 5194, and 5195 of the said "Improv - ment Act of 1911 ", of said Streets and Highways Code. POSTING OF NOTICE OF IMPROVEMENT SECTION 8. The Superintendent of Streets of the City of Newport Beach, shall cause to be conspicuously posted along the line of said contemplated work or improvement and along all open streets within the district liable to be assessed for said work, notices of the passage of this Resolution of Intention, in the time, form and manner provided by said Code.
