HomeMy WebLinkAbout3692 - Street Improvement Assessment• 1 i 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 171 18' 19 20 21 22 23 24 25 26 27 28 29 C 0 P Y RESOLUTION NO. 3692 RESOLUTION OF TIE CITY COUNCIL OF THE CITY OF MVJPORT BEACH, CALIFORNIA, ADOPTED PURSUANT TO THE REQUIREMENTS OF THE "SPECIAL ASSESSMENT INVESTIGATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931 "1 BEING PART 2, DIVISION IV OF THE STREETS -IIND HIGII<?AYS CODE OF THE STATE OF CALIFORNIA. FIHEREAS, the City Council of the City of Newport Beach, California, having heretofore instructed the City Engineer in the matter of the proposed improvement of Lake Avenue and other streets (Lake Tract) to procure the data and prepare a written report pursuant to the provisions of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931 ", being Part 2, Division IV of the Streets and Iiighways Code of the State of California, and thereafter the said City Engineer presented to this City Council the said written report; and VWREAS, pursuant to the provisions of said Part 2, Division IV of the said Streets and Highways Code, the City Council shall, be resolution or ordinance, determine in general the nature, location and extent of the proposed improvement; generally define the boundaries or extent of the district or lands to be specially assessed to pay the costs thereof, or any part of such costs; and determine the statute under which it is proposed to conduct the proceedings for such improvement and for the issuance of bonds therein, if any. NOW, THEREFORE, BE IT RESOLVED AND DETERMINED by the City lCouncil of the City of Newport Beach, California, as follows: 1. That the written report presented by the City Engineer for the proposed improvement herein referred to is hereby approved, and lit is ordered that the said report be filed in the office of the ity Clerk for public inspection. 3011 2. (b) The grading, paving with plant mix material, construction of cement concrete curbs, gutters, sidewalks, alley approaches, sewer and water service connections, ornamental street lighting system and appurtenant work in connection therewith; In MARCUS AVENUE between 32nd Street and a line parallel to and distant 130 feet Northwesterly from the Northwesterly line of 36th Street. (c) The grading, paving with plant mix material, construction of cement concrete curbs, gutters, alley approach, sewer and water service connections, catch basins and storm drain, ornamental street lighting system and appurtenant work in connect therewith; In 321\TD STREET between the Southeasterly prolongation of the Southwesterly line of Lot 23, Block 132, Lake Tract, as per map recorded in Miscell Map Book 4, Page 13, Records of Orange County, California, and the Northerly prolongation of the Easterly line of Lot 13, Block 231 of said Lake Tract. (d) The grading, paving with plant mix material, curbs, construction of cement concrete /gutters, sewer and water service connections, catch basins and storm drains, ornamental street lighting system and appurtenant work in connection therewith; - 2 - C O P Y a 1 In 2 33RD STREET, • 3 34TH STREET and 35TH STREET 4 between a line parallel to and distant 25 feet Northeasterly from 5 the Northeasterly line of said Lake Tract. 6 3. That all of said work and improvement, proposed to be 7 done, shall be constructed along the lines, between the points and 8 at the places shown on Map No. 427, consisting of one sheet, filed 9 with the said report and by this reference made a part hereof. 10 4. That the district or lands to be specially assessed to I 11 pay a portion of the costs of said proposed improvement, is shown 12 upon Map No. 427, consisting of one sheet, filed with and forming 13 a part of said written report. Reference is hereby made to said 14 map for further, full and more complete description of said assess - 15 ment district, and the said map so on file shall govern for all 16 details as to the extent of said assessment district. 17 5. That it is hereby determined that the City of Newport 18 Beach will contribute out of its General Fund the sum of $3500.00 19 toward the costs and expenses of said improvement above described, 20 and the balance of said costs and expenses shall be assessed upon 21 the district described in Paragraph 4, hereof. 22 6. That the proposed improvement shall be done under the 23 provisions of the "Improvement Act of 1911 ", being Division VII of 24 the Streets and Highways Code of the State of California. 25 7. That serial bonds, bearing interest at the rate of six 26 per cent (6 %) per annum, and extending over a period ending nine 27 (9) years from the second day of January next succeeding the next • 28 October fifteenth following their date, shall be issued hereunder • 29 in the manner provided by the said "Improvement Act of 1911 ", being 30 Part 5, Division VII of said Streets and Highways Code, to renresen 31 each assessment of Twenty-five Dollars ($25.00 y- ),or more, remaining unpaid for thirty (30) days after the date of recording the assess- ment warrant. - 3 - 1 • 2 • 3 • Alk MW 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 COPY fir) 8. That the said City Council hereby fixes Monday, the 27th day of June, 1949, at the hour of seven - thirty o'clock (7:30) P. MI. as the date and hour, and the Council Chamber of the City Council in the City Hall of said city as the place of hearing on the written report of the City Engineer, and hereby orders such hearing to be held by the City Council of said city.
