RESOLUTION NO. 3730
1 WHEREAS, the City of NoWort Beach is the ear of the.
2 real property hereinafter'*600.,particularly described; and
3 WHEREAS,.said real property is not necessary for public
4 use by said City of Newport Beach; and
5 WHEREAS, the City Council of the City of Newport Beach
6 heretofore Invited bids for the pdrohase from the City p! Newport
7 Beach of the real property hereinafter more particularly deseribedf
8 and WHEREAS, pursuant to said invitation, an offer has been
9 presented to the City of ■ewport Beach by Ralph P. Maskey, a 11-
10 canoed real estate broker, on behalf of John A. Matthay for the
11 purchase of said real property at a total price of 033,100.00, upon

12 condition that the buildings now on said real property be removed
13 by the City of Newport Beach at its own expense; and
14 WHEREAS, said offer is the highest and best bid made for
15 the purchase of said real property; and
16 WHEREAS, the City of Newport Beach deems that said price
to
17
of $38,100.00 /be the fair market value of said real property, ai-
18 lowing for the removal of said buildings at the expense of the City
19 of Newport Beach; and that it is for the best interest of the City
20 of Newport Beach that said real property be so sold as aforesaid.
21 NOWT, THEREFORE, BE IT % "OLVED that the City of Newport
22 Beach accept and it hereby accepts the offer of John A. Matthay to
23 buy from the City of Newport Beach the real property situate in
24 the City of Newport Beach, County of Orange, State of California,
25 and more particularly described as follows:
26 PARCEL 1. The Northerly 77 feet of Lots Fourteen to Thir-
ty, both inclusive, In Block Five hundred Thirty of Lan -
27 caster's Addition to Newport Beach, as shown on a Map
recorded in Book 5, page 14 of Miscellaneous Maps, re-
28 cords of Orange County, California.
29 Except from that portion of Lot Fourteen herein des-
cribed that part described as follows: Beginning at
30 a point in the Easterly line of said Lot Fourteen,
said point of beginning being tangent to a curve con -
31 cave to the Southwest and .aving a radius of 40 feet,
said curve also being tangent to a line 26 feet mea-
32 cured at right angles Northerly of, and parallel to, the

Northerly line of said Let,.'oarteen; thence Northerly

said Northerly line to the Northeasterly Qorner of said
Lot Fourteen; thence Southerly along the Easterly line
of said Lot Fourteens, to the point of beginning.
PARCEL 2. That portlop.of 32nd Street, rormerly Wash-
ington Avenue, as shotp on said map recorded in Book,
page 14 of Miscellaneous N s, records of Orange Goun y,
California#- vaoated March I3th, 1950 by Resolution 377
of the City of Newport Bea adjoining Parcel 1 an the
Worth and more particularly leseribed as follower
Beginning at the Northweeterlyy corner of Lot Thirty in
Block Five Hundred Thirty, Lancaster's Addition to NOW
port Beach, as shown.on a map recorded in Book 5, page l4
of Miscellaneous Maps .records of Orange County, Calif-
ornia, %hence Northerly along the Northerly prolongation
of the Westerly line of said Lot Thirty, a distanoe of 11
feet to the beginning of a curve concave to the Southeast,
having a radius of 15 feet;.thenoe along said curve a dis-
tance of 23.56 feet through a central angle of 90 to a
point, said point being in a line 26 feet measured at
right angles Northerly of and parallel to the Northerly
lines of Lots Thirty to Fourteen inclusive, of said
Block five Hundred Thirty; thence Easterly along said
parallel line to the beginning of a curve concave to
the Southwest having a radius of 4o feet, said curie
also being tangent to the Easterly line of Lot Fourteen
of said Block Five Hundred Thirty; thence along said
ourve to.an intersection with the Northerly line of said
Lot Fourteen; thence Westerly along the Northerly line
of said Late Fourteen to Thirty ".inclusive to.the point
of beginning,
for the sum of $35,100.00, upon condition that the City of New-
port Beach, within six months from date hereof, remove the build-
ings which are presently upon said real property, and upon the
further condition that until such time as said buildings are so
removed, the City of Newport Beach .hall deduct from said purchase
price of $35,100.00 a sum equivalent to six (6) per cent per annum
on the sum of $3,810.00 from the date hereof until said removal is
accomplished; and
BE IT FURTHER RESOLVED, that the City Attorney be and he
hereby is authorized to make, execute and sign an behalf of the
City of Newport Beach escrow instructions for the purpose of
ing said sale and purchase, and
BE IT FURTHER RESCLVEL, that the Mayor of the City of New-
port Beach and the City Clerk of the City of Newport Beach be and

they hereby are authorized p make, execute and deliver a good and
sufficient grant" deed and ariy "end all other documents necessary or
expedient so as to vest title in said John A. Matthay to said real
property subject only to conditions, restrictions, reservations
or rights of way.of record; and
BE IT FURTHER RESOLVED, that in pursuance of said sale,
the City of HewparL Beach procure, at its own expense, a oertifi-
cate of title showing title to said real property so vested in sat
John A. Matthay as aforesaid; and
BE IT FURTHEii RESOLVED, that the commission upon said
sale, which ooadasion is fixed at 41,905.00, be paid to said
Ralph F. Maskey in compensation for his services in connection
with said sale.
The above and foregoing Resolution was duly passed and
adopted at a regular meeting of the City Council of the City of
Newport Beach hold on the 12th day of September, 19490 by the
