HomeMy WebLinkAbout3726 - Lake Avenue Public Improvements• • • • 1 2 3 4 5 6 7 8 9 10 11 12 13 14' 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 C 0 P Y RESOLUTION OF INTENTION NO. 3726 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEVTPORT BEACH, CALIFORNIA DECLARING ITS INTENTION TO ORDER CONSTRUCTION OF CERTAIN PUBLIC IMPROVEMENTS IN LAKE AVENUE AND OTHER STREETS IN SAID CITY: DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUB- LIC BENEFIT AND DESCRIBING THE DISTRICT TO BE BENEFITED BY SAID WORK AND TO PAY THE COSTS AND EXPENSES AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS TO SAID WORK. 7.- The City Council of the City of Newport Beach, pursuant to the provisions of the "Improvement Act of 1911 ", being Division VII of the Streets and Highways Code of the State of California, do resolve as follows: SECTION 1. That the public interest and convenience require, and it is the intention of the City Council of the City of Newport Beach, California, to order the following work to be done, to -wit: DESCRIPTION OF WORK First: The grading, paving with 2 -inch plant mix mater laid upon a 5 -inch untreated rock base, construction of cement con- crete sidewalks, cement concrete curbs, cement concrete gutters, cement concrete alley aprons or approaches, construction and in- stallation of a street lighting system consisting of cement concrete posts or standards, lamps, conduits, cables, wires and other suitab and necessary appliances for the purpose of street lighting, togeth with appurtenant work in connection with all items of improvement herein mentioned; in LAKE AVENUE between Thirty- second Street and Thirty -sixth Street, as shoom on Sheets Nos. 3 and 6 of the plans hereinafter referred to. - 1 - 1 • 2 • 3 4 5 6 7 8 9 10 11 12 13 0 • 14 15, 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 COPY via Second: The grading, paving with 2 -inch plant mix material laid upon a 5 -inch untreated rock base, construction of cement concrete sidewalk, cement concrete curbs, cement concrete gutters, cement concrete alley aprons or approaches, corrugated metal storm drain pipes, storm drain catch basins, installation of i house sewer connections and house water connections, construction and installation of a street lighting system consisting of cement concrete posts or standards, lamps, conduits, cables, wires and other suitable and necessary appliances for the purpose of street lighting, together with appurtenant work in connection with all it of improvement herein mentioned; in MARCUS AVENUE between Thirty- second Street and a line 124 feet Northwesterly from and parallel with the Northwesterly line of Thirty -sixth Street, as shown on Sheets Nos. 3, 4 and 6 of said plans. Third: The grading, paving with 2 -inch plant mix mater laid upon a 5 -inch untreated rock base, cement concrete curbs, cement concrete gutters, cement concrete alley aprons or approaches corrugated metal storm drain pipes, storm drain catch basins, installation of house sewer connections and house water connections construction and installation of a street lighting system consistin of cement concrete posts or standards, lamps, conduits, cables, wir and other suitable and necessary appliances for the purpose of street lighting, together with appurtenant work in connection with I Iall items of improvement herein mentioned; in THIRTY- SECOND STREET between a line drawn parallel with and distant 25 feet Northeaster from the Northeasterly line of that portion of Balboa Boulevard ly (Northwesterly of said Thirty- second Street, and the Southerly pro- longation of the Easterly line of Clubhouse Avenue, as shown on Sheets Nos. 4 and 6 of said plans. - 2 - C 0 P Y 1 1 Fourth: The grading, paving with 2 -inch plant mix • 2 material laid upon a 5 -inch untreated rock base, construction of • 3 cement concrete curbs and gutters, corrugated metal storm drain 4 pipes, storm drain catch basins, installation of house sewer 5 connections, construction and installation of a street lighting 6 system consisting of cement concrete posts or standards, lamps, 7 conduits, cables, wires and other suitable and necessary appliances 8 for the purpose of street lighting, together with appurtenant work 9 in connection with all items of improvement herein mentioned; in 10 THIRTY -THIRD STREET, THIRTY - FOURTH STREET 11 and THIRTY -FIFTH STREET 12 between a line drawn parallel with and distant 25 feet Northeasterly 13, from the Northeasterly line of Balboa Boulevard and the Northeasterl 14 end of streets, as shown on Sheets Nos. 4, 5 and 6 of said plans. 14 Fifth: The construction of corrugated metal storm drain 16: 17 pipe and appurtenant work; in CLUBHOUSE AVENUE 18 between the catch basin to be constructed adjacent to the Northerly 19 curb line of Thirty- second Street at its intersection with Clubhouse 20 21 Avenue and thence running Northerly a distance of approximately 55 22 feet to The Rivo Alto, as shown on Sheet No. 4 of said plans. PLANS, PROFILES, DRAWINGS 23 AND SPECIFICATIONS 24 SECTION 2. All of the said work and improvement to be 25 done, shall be constructed upon the grades, along the lines, between 26 the points, of the dimensions, at the places and in the manner shown 27 • on the plans, profiles and drawings for the construction of said 28 improvements, being Plan No. 426 consisting of six (6) sheets, and •29 Standard Plans Nos. 1005, 1061 and 1063, on file in the office of th 30 City Engineer of said City and, except as otherwise provided on said 31 plans, in further accordance with the specifications for the constru - 32 tion of said improvements, said specifications being on file in the - 3 - C 0 P Y . c Zc 1 office of the City Cleric of said City, and to which plans, profiles, 2 drawings and specifications heretofore approved by the City Council • 3 of said City, reference is hereby made for a further, full and more 4 particular description of the said work, and by reference thereto 5 the same are incorporated herein and made a part hereof. 6 DESCRIPTION OF ASSESSMENT DISTRICT 7 SECTION 3. That the said contemplated work and improve- 8 ment, in the opinion of the said City Council, is of more than local 9 or ordinary public benefit, and the said City Council hereby makes 10 the expenses of said work and improvement chargeable upon a district 11 which said district the said City Council hereby declares to be the 12I district benefited by said work and improvement, and to be assessed 13 to pay the costs and expenses thereof, and which district is 14 described as follows: 15 All that certain territoryof the City of Newport Beach, 16 California, exclusive of streets and alleys, included within the 17 exterior boundary line shown upon that certain Map or Plat Ro. 426, 18 consisting of one sheet, attached to and forming a part of the 19 Investigation Report, prepared and filed under the provisions of the 20 "Special Assessment, Investigation, Limitation and Majority Protest 21 Act of 1931 ", Division IV of said Streets and Highways Code, hereto - 22 fore approved by the City Council of said City on the 23rd day of 23 May, 1949, indicating by said boundary line the extent of the 24 territory included within the proposed assessment district, and iihic 25 map or plat is on file in the office of the City Clerk of said City. 26 Reference is hereby made to said map or plat for a further, full and • 27 more particular description of the said assessment district, and 28 the said map or plat so on file shall govern for all details as to • 29 the extent of the said assessment district. 30 DESCRIPTION OF BONDS 31 SECTION 4. That serial bonds, bearing interest at the 32 rate of six per cent (67.) per annum, shall be issued to represent each assessment of Twenty -five Dollars ($25.00) or more, remaining - 4 - - 5 - C 0 P Y s' 1 unpaid for thirty (30) days after the date of the warrant. Said 2 serial bonds shall extend over a period ending nine (9) years from • 3 the second day of January next succeeding the next October fifteenth 4 following their date. Payments on the principal of unpaid assess - 5 ments and interest thereon shall be made by property owners to the 6 City Treasurer, and the same shall be disbursed by said City Treasury 7 er, all as provided in the "Improvement Act of 1911 ", hereinafter 8 referred to. 9 PORTION OF COSTS AND EXPENSES TO BE PAID OUT OF THE TREASURY 10 OF SAID CITY OF NEWPORT BEACH 11 SECTION 5. Notice is hereby given that the said City 12 Council of the City of Newport Beach has heretofore determined and 13 declared that the said City will pay out of its.General Fund the sum 14 of $3500.00 toward the costs and expenses of said improvement. The 15 liability and obligation to pay such sum, as provided herein, shall 16 accrue and become fixed upon the date of the confirmation of the 17 assessment by the City Council of said City. 18� TIME AND PLACE OF HEARING 19 SECTION 6. NOTICE IS HEREBY GIVEN, that on the 10th day 20 of October, 1949, at the hour of seven - thirty (7:30) o'clock P.M., 21 in the Council Chamber of the City Council in the City Hall of said 22 City of Newport Beach, any and all persons having any objections to 23 the proposed work or improvement, or to the extent of the assessment 24 Idistrict, or to the proposed grades, may appear and show cause why 25 said work should not be done or carried out in accordance crith this 26 Resolution of Intention. Protests must be in writing and must be 27 delivered to the City Clerk prior to the time set for the hearing. 28 IMPROVEMENT ACT • 29 SECTION 7. That all of the work herein proposed shall b 30 done and carried through in pursuance of an act of the legislature o 31 the State of California, designated the "Improvement Act of 1911 ", 32 being Division VII of the Streets and Highways Code of the State of California. - 5 - 3 4 5 6i 7 8 9 10 11 12 131 14 15 16 17 18 19 20 21 22 231'' 24 2511 26 27 28 29 30 31 32 3' PUBLICATION OF PESOLUTION OF INTENTION SECTION 8. The "Newport Balboa- Press ", a weekly news- paper, printed, published and of general circulation in the City of Newport Beach, California, is hereby designated as the newspaper in which this Resolution of Intention shall be published by the City Clerk, in the manner and form provided by law, and for making all other publications in the proceedings under this Resolution of (Intention. The City Clerk is directed to mail notices of the adoption of this Resolution of Intention to all persons owning real property, proposed to be assessed, whose names and addresses appear on the last equalized assessment roll for city taxes, all in the manner and form provided for under Sections 5070, 5194 and 5195 of the said "Improvement Act of 1911" of said Streets and Highways Cod POSTING OF NOTICE OF IMPROVEMENT SECTION 9. The Superintendent of Streets of the City Newport Beach shall cause to be conspicuously posted along the line of said contemplated work or improvement and along all open streets within the district liable to be assessed for said work, notices of the passage of this Resolution of Intention, in the time, form and manner provided by said Code. INVESTIGATION REPORT SECTION 10. That the written report of the City En of the City of Newport Beach on the proposed improvements herein described and prepared, pursuant to the provisions of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931 ", being Division IV of the Streets and Highways Code of the State of California, is on file in the offices of the City Clerk of said City and open to public inspection.
