RESOLUTION OF AWARD OF CONTRACT
NO. 3746
RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, A[ +LARDING THE
CONTRACT FOR THE WORK DESCRIBED IN RESOLUTION
OF INTENTION NO. 3726.
RESOLVED, that the City Council of the City of Newport
Beach, California, having in open session on the 14th day of
November, 1949, publicly opened, examined and declared all sealed
proposals or bids for the following work to be done and improvemen
to be made in said City, to -wit:
The grading, paving with 2 -inch plant mix material laid
upon a 5 -inch untreated rock base, construction of cement concrete
sidewalks, curbs, gutters, alley aprons or approaches, storm drains,
house sewer connections, house water connections, street lighting
system, together with appurtenant work in connection therewith, in
Lake Avenue and other streets, all as more particularly described
in Resolution of Intention No. 3726, passed and adopted by the
City Council of said City on the 29th day of August, 1949 and on
file in the office of the City Clerk of said City.
For further particulars, reference is hereby made to
said Resolution of Intention No. 3726 and to the plans, profiles a.
drawings No. 426, consisting of 6 sheets, on file in the office of
the City Engineer of said City of Newport Beach, and to the speci-
fications for the said work heretofore adopted by the said City
Council and on file in the office of the City Clerk of said City,
and all of said plans, profiles, drawings and specifications here-
tofore approved by the City Council of said City are incorporated
herein and made a part hereof, and reference is hereby made there-
to for a more particular description of said work.
Said City Council has determined and declared that the
contemplated work and improvement heretofore mentioned etas, in the
opinion of said City Council, of more than local or ordinary public
benefit, and the said City Council has made the expenses of said

1 City Council has made the expenses of said work char;eable upon
2 a district. For the particular description of said district,
3 reference is hereby made to said Resolution of Intention No. 3726.
4 Said Council has determined and declared that serial bonds
5 bearing interest at the rate of six per cent (6%) per annum and
6 extending over a period ending nine (9) years from the second day
7 of January next succeeding the next October 15th following their
8 date, will be issued hereunder in the manner provided by the "Improv
9 ment Act of 1911 ", being Part 5, Division 7 of the Streets and
10 Highways Code of the State of California, to represent each assess -
11 ment of Twenty -five Dollars ($25.00) or more remaining unpaid for
12 thirty (30) days after the date of the warrant.
1311 Said City Council has determined and declared that the
14 City will pay out of its General Fund the sum of $3500.00 toward
15 the costs and expenses of said improvement. The liability and
16 obligation to pay such sum, as provided in said Resolution of
17 'Intention No. 3726, shall accrue and become fixed upon the date of
18 the confirmation of the assessment by the City Council of said City.
19 All of the work herein ordered shall be done and carried
20 through in pursuance of an act of the Legislature of the State of
21 California, designated the "Improvement Act of 1911 ", being
22 Division 7 of the Streets and Highways Code.
23 Said City Council hereby rejects all of the said-proposals
241 or bids, except the next hereinafter mentioned, and hereby awards
25 the contract for the said work and improvement to the lowest,
26 regular and responsible bidder, to -wit: To Sully-Miller 1Miller Contractin
27 Company at the prices named in said bid for said work,
28 on file in the office of the City Clerk of said City.
29 The City Clerk of said City is hereby directed to cause
30 a NOTICE OF AWARD OF CONTRACT to be published in the manner and
31 form required by said Code, by two insertions in "Newport - Balboa
32 Press ", a weekly newspaper, published and circulated in said City
of Newport Beach and hereby designated for the purpose by the said
City Council.

the 14th day of November, 1949 by the following vote, to -exit:
