HomeMy WebLinkAbout4180 - Seaquist Parcel AnnexationE 0 • 1 I RESOLUTION No. �lLO 2 3 WHEREAS, the County of Orange has heretofore filed 4 against the City of Newport Beach a Petition for a grit of Man- s , date to stop the City of Newport Beach from proceeding with the 6 annexation of the Seaquist parcel, pursuant to the original re- 7 quest of William S. Seaquist, to acted upon at the February 9, 8 1953 meeting of this Council; and 9 WHMA$, the Vest half of said Seaquist Parcel was sub - 10 sequently included within the boundaries of the City of Costa i?e6 11 by action of the Hoard of Supervisors and as a result of the in- 12 corporation election in the.City of Costa Hera; and 13 WHEREAS. the respective City Councils of the Cities of 14 Costa Mesa and Newport Beach agreed that the future status of the 15 said Viest half of the Seaquist Parcel should be determined as the is result of a so- called "straw vote" of the residents therein; and 17 WW;REAS, said straw vote was held and the vote of the 18 majority was that said parcel should be included within the City 19 of Newport Beach; and 20 WHEREAS, some final determination should be made of the 21 aforementioned Petition for Writ of Mandate; and 22 WHEREAS, it appears to be for the best interests of the 23 citizens of the City of Newport Beach that said rit of mandate 24 be granted as to the original annexation proceeding and be made 25 permanent,. and that the residents in said 'westerly half of said 26 Seaquist Parcel should proceed with a new annexation proceeding; 27 and 28 MrS.REAS, it has been determined by the City Attorney 29 of the City of Newport peach that the City of Newport Beach had 30 no legal right to proceed further with the annexation of the so- 31 called Goddioksen Parcel as the same was instituted by the Peti- 32 I tion received and filed on April 20, 1953; 1 I 1. • 2 • 3 4 5' 6 7I8 9,. 10 11 12 13 14 15 16 , 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 NOWs THEi FORS -0 BE IT RUCLVIM thst the City Council 1W the City of Newport Beach hereby authorizes the making permanent of the Alternative grit of Itsndate heretofore issued by the Sup - erlor Court, and hereby agrees that the City of Newport Beach wi take no further steps towards the annexation of said westerly ha of the leaquist Parcel under and. by virtue of the original reque of the said William Ws, Beaquist as filed with the City on Februa 91 1953, nor will the said City of Newport Desch take any, furthe steps towards the annexation of the so- called Goddickeen Parcel.
