RESOLUTION NO. 4365
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH, CALIFORNIA, ORDERING THE WORK DESCRIBED IN
RESOLUTION OF INTENTION NO. 4355, ADOPTED ON THE
25TH DAY OF JULY, 1955, IN THE MATTER OF THE INSTALLA-
TION OF SANITARY SEWERS IN CLIFF DRIVE AND OTHER
STREETS AND RIGHTS OF WAY IN THE CITY OF NEWPORT
BEACH, CALIFORNIA.
THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, pur-
suant to the provisions of the "Improvement Act of 1911 ",
being Parts 1, 2 and 3, Division 7 of the Streets and Highways
Code of the State of California, DOES HEREBY RESOLVE AS FOLLOWS:
That the public interest and convenience require the work
hereinafter mentioned to be done and, therefore, the said City
Council hereby orders the following work to be done and improve-
ments to be made in said City, to wit:
The installation of sanitary sewers in Cliff Drive and other
streets and rights of way, and appurtenant work in connection there
with, all as more particularly described in Resolution of Intention
No. 4355, passed and adopted by the City Council of said City
on the 25th day of July, 1955, and on file in the Office of the
City Clerk of said City.
For all further particulars reference is hereby made to said
Resolution of Intention No. 4355 and to the plan and profiles
on file in the Office of the City Engineer of said City, and to
the specifications for said work heretofore adopted by said City
Council and on file in the Office of the City Clerk and in the
Office of the City Engineer of said City, and all of said plan,
profiles, and specifications heretofore approved by the City Counc
of said City are incorporated herein and made a part hereof and
reference is hereby made thereto for a more particular description
of said work.
Said City Council has determined and declared that the con-
templated work and improvement heretofore mentioned was in the
opinion of said City Council of more than local or ordinary public

1 benefit and said City Council has made the expense of said work
• 2 chargeable upon a district. For the particular description of
3 said district, reference is hereby made to said Resolution of
4 Intention No. 4355.
5 Said City Council has determined and declared that serial

bonds bearing interest at the rate of six per cent (6%) per annum
7
and extending over a period ending nine (9) years from the second
8
day of January next succeeding the next October 15th following
9
their date, will be issued hereunder in the manner provided by
10
the "Improvement Act of 1911 ", being Part 5, Division 7 of the
11
Streets and Highways Code of the State of California, to represent
12
each assessment of Twenty -five Dollars ($25.00), or more, remain -
13
ing unpaid for thirty days after the date of recording the warrant.

All of the work herein ordered shall be done and carried
15
through pursuant to an Act of the Legislature of the State of
16
California, designated at the "Improvement Act of 1911 ", being
17
Parts 1, 2 and 3 of Division 7 of the Streets and Highways Code
18
of said State.

The City Clerk of said City is hereby directed to post
20
conspicuously for five days on or near the Council Chamber door,
21
in the manner and form required by said Code, a notice inviting
22
sealed proposals or bids for doing the work herein ordered, and
23
the City Clerk is hereby directed to publish twice in the "NEWPORT
24
HARBOR NEWS PRESS ", a newspaper of general circulation published
25
and circulated in said City and hereby designated by said City
26
Council for that purpose, a notice inviting such proposals or bids

for doing the said work and referring to the specifications on file
28
APPROVED and ADOPTED by the City Council, signed by the

Mayor, and attested by the City Clerk this 22nd day of August, 1955
