1 I RESOLUTION NO.

3 WHEREAS, there has this day been presented to the City
4 Council of the City of Newport Beach a certain Agreement dated
5 #ugust may_, 1955, between the City of Newport Beach and John
6 Charles Kirk covering the cancellation and termination of an
7 Agreement between them for the operation of a concession on
8 the Balboa pier, said Agreement being dated August 10, 1953; and
9 WHEREAS, it appears to be for the best interests of
10 the citizens of the City of Newport Beach that the said Agreement
11 to cancel and terminate the Agreement of August 10, 1953 be
12 entered into;
13 NOW, THERMRE, BE IT RESOLVED, that the Mayor and the
14 City Clerk be and they are hereby authorized and directed to
15 execute said Agreement in behalf of the City and to deliver an
16 executed copy thereof to the said concessionaire, John Charles
17 Kirk.
18 The above and foregoing Resolution was duly and
19 regularly passed and adopted by the City Council of the City of
20 Newport Beach at a regular meeting thereof held on the 22nd day
21 of August, 1955, by the following vote, to wit:

THIS AGRT,MTT, made and entered into this a_.day of
August, 1955, between. the City of Newport Beach, hereinafter
designated "City" and John Charles Kirk, hereinafter designated
"Kirk ",
a :ert,ain agreement entered into by them on the 10th day of
August; 1953, whereby the City granted to Kirk the privilege of
operating a certain concession on the Balboa pier in the City of
Newport Beach; and
WHRRF,AS, the City and Kirk have entered into a new
agreement concerning; the same subject matter of that certain
agreement entered into by them on the 10th day of August, 1953;
NOW, THEREFORE, in consideration, of their mutual
promises, the parties hereto agree to and do hereby terminate
and cancel effective Atv ust 31, 19551 that certain agreement
entered into by them on the 10th day of August, 1953.
