HomeMy WebLinkAbout4425 - Tract 27 Vacation & Abandonment04 7 8 9 10 11 12 13 14 15 18 17 18 19 20 21 22 23 28 28 27 28 29 30 31 32 RESOLUTION NO. 4425 A RkZOLUTI0N OF INTrNTIot, OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DI4,CLARIJ'Z ITS INTENTION TO Dhi�ER THE CLOSING .UP, VACAilOifi AIX ABANDONMENT OF THAT CFFTAIH PUBLIC HIGHWAY OVE.F LOT 240 Block 9z TRACT NO. 27 IN THE CITY OF NEWPORT BRACH, COUNTY OF ORANGE, STATE OF CALIFORNIA The City Council of the City of i<ewport Beach, pursuant to the provisions of the "Street Vacation Act of 1941 ", and all amendments thereto, being Section 8300 through 8331 of the Streets land Highways Code, does hereby ordain, resolve and declare as 1 follows 3 SECTION Is That the public interest and convenience require the closing up and abandonment of that certain public highway over Lot 24, Block 9, Tract Pao. 27, and vacated street adjoining on the West, in the City of Newport Beach' and it is Ithe intention of the City Council of the City of Newport Beach to border the following described property in said City of Newport Beach, County of Orange, State of California, to be vacated, y closed up and abandoned, to wits A triangular shaped parcel of land being a p©rtion of that portion of Lot 24, Block 9, and vacated street adjoining on the West as shown upon a map of Tract No. 27 recorded ir. Miscellaneous Maps 'took 9, page 26, Records of Orange County,.,State of Calif- ornia, that was granted to the E':tate of California for a public highway and described in deed recorded In ,Book 809E page 860 Official liecords, Records of Orange County California, and more particularly described as lollowss Beginning at a point in the northwestwrly line of the 80 foot strip of land described in deed from John J. Thornton et al to the County of Orange, re- corded in Book 72, page 131 of Official Records of said orange County, which point is the southerly end of that certain tangent course in said north- westerly line having a length of 157.44 feet and a bearing of South 34° 59' 35" West; thence from said point of beginning South 340 51' 35" West along the southwesterly prolongation of said tangent course a distance of 297.75 feet to a point in the center line of that certain 40 foot street adjoining said Lot 24 on the west as vacated by the Board of Super- visors of said Orange County, a certified copy of which order is recorded in Hook 2_360 page 273 of Official Records, records of said Orange County; -1- y 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24, 28 26 27 28 29 30 31 32 thence South 800 4C' 1C11 Fast a distance of 32 feet ;. thence North 291 481 42" Bast to a point of inter- section with the said northwesterly line of the afore - mentioned 80 foot atrip of land, said point of intersection being in a curve concave to the Southeast and having a radius of 1040 feet; thence northeasterly along said curve and said northwest- erly 1"Ine to the point of beginning. Said public highway to be vacated, closed up and is more clearly shown on a certain map a:roved and adopted by the City Council of the City of Newport Beach for said vacation, closing up and abandonment, by resolution dated December 27, 19559 and designated "Resolution NO. 4,440, which said map is on file In the office of the Gity Clerk of the City of Rewport Beach. Reference is hereby made to said reap for further particulars as to the proposed vacation, closing up and abandonment of said public highway, and said map is :Wade a part of this resolution to the same extent and purpose as if the same were herein incorporated in full. SECTION 21 That the proceedings for the closing up and abandonment of the aforesaid public highway shall be had and taken, and the City Council of the City of Newport Beach hereby elects to proceed under the provisions of the said "street Vacation Act of 1941 ", and all amendments thereto, being Sections 830G through 8331 of the Streets and Highways Code of the State of California. SECTION 3s The Street Superintendent of the City of Newport Beach shall cause to be posted conspicuously along the line of that certain public highway proposed to be vacated, not more than 300 feet apart, but not less than three in all, notices of the vacation of said public highway, Said notices shall state the preparation of this Resolution of Intention and the time and place of the hearing of all persons interested in or objecting to the proposed vacation of said certain public highway. SECTION 4t Notice is hereby given that the City Council 11of the city of Newport Beach does hereby fix ?Monday, the 23d day -2- 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16� 17 18 19'i 20 21 22 93 24. 26, 26 27. 28 29 30 31 32 January, 1956, at the hour of 7 :30 P.M. of said day, in the Council Chambers of the City of Newport Beach, located in the City Hall of the City of Newport Beach, as the tLue and place for hearing all persons interested in or objecting to the proposed vacation of., said public highway; and the said City Council of the said city pf Newport beach at said time and place will hear the svidsnCe, offered, by any person interested in the vacation of said public highway?' heretofore described. Z. SECTION 5; This Resolution of Intention shall be pub - lished At least once in the Newport Harbor News - Press, a newspaper of general/circulation, printed, published and circulated in the City of "wport Beach, and said publication sha71 be made prior to the date set for the hearing of all persons interested in or object ng to the proposed vacation.
