RESOLUTION NO. 5197
A RESOLUTION OF THE CITY COU14CIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF A
CONTRACT FOR THE SALE OF WATER
511 WHEREAS, the City of Newport Beach has entered into a
6 contract with The Irvine Company and Lockheed Aircraft Corporation
7 providing for the construction of water facilities for the dls®
8 tribution of water to Lockheed in the City and for the transmission
9 and sale of water to The Irvine Company or its successors for use
10 in that area of Coastal Municipal Water District outside the City
11 bounded by MacArthur Boulevard, Paularino Road, and San Joaquin
12 Road; and
13 WHEREAS, said agreement provides that there will be an
14 additional agreement setting out the terms under which the sale of
15 water will be made for use in said area of Coastal outside the City;
16 II and
17 WHEREAS, a contract has been prepared between the City
18 and The Irvine Company under which the City will transmit water to
19 the northerly boundary of City for sale to Irvine or its successors
20 for use outside the City, and the same has been found to be fair
21 and reasonable;
22 NOW, THEREFORE, BE IT RESOLVED that said agreement is
23 hereby approved and that the Mayor and City Clerk are hereby au
24 ized and directed to execute the same on behalf of the City.
