2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING TIM, =CUTION OF AN
3 AGREEMENT WITH MARVIN E. KIRIWOOD AND JOAN A.
KIR1WOCD'

5 m EREAS, Marvin E. Kirkwood and Joan A. Kirkwood filed
6 resubdivision application No. 104 seeking to divide into two
7 separate lots a portion of Block A of Corona del Mar in the City
8 of Newport Beach, which the Planning Commission approved on condi-
9 tion that the applicants enter into a contract with the City of
10 Newport Beach agreeing to do certain work in connection therewith
11 and to post a bond to guarantee performance thereof; and
12 WORMS, such an agreement has been presented to the City
13 Council of the City of Newport Beach and the City Council has con -
14 sidered the terms and conditions thereof and found them to be fair
i
15 and equitable, and the required surety bond has been filed with the
16 City and approved by the City Attorney as to form;
171 N%T7 THEREFOR:, BE IT RESOLVED by the City Council of the
18 City of Newport Beach that said agreement between Marvin E. Kirkwoo
19 and Joan A. Kirkwood and the City of Newport Beach be approved and
20 the Mayor and City Clerk are authorized and directed to execute the
21 same on behalf of the City of Newport Beach.
22 BE IT FURTHZR RESOLVED that the City Clerk is authorized
23 and directed to record said agreement and execute any certificate
24 necessary to accomplish the recording.
