• 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF.A
• 3 CONTRACT_

5 WHEREAS, John F. Vogel and others have heretofore applied
6 for a resubdivision of the southeasterly 130 ft. of Lot 27, Newport
7 Heights Tract, as per map recorded in Book 4, page 83, of Miscel-
8 laneous Maps, records of Orange County; and
9 WHEREAS, the subdivision was approved by the Planning
10 Commission on condition that certain street right- of-way be dedi-
11 Gated and approved; and
12 WHEREAS, a dispute subsequently arose and the work was
13 not done; and
14 WHEREAS, litigation developed in a Superior Court case
15 entitled "City of Newport Beach v. Sanger, et al ", being Superior
16 Court No. 84329; and
17 WHEREAS, the parties now wish to settle the action by
18 entering into an agreement for the dedication and improvement of
19 street right -of -sway over said southeasterly 130 ft, of said Lot 27;
20 and
21 WHEREAS, a contract setting out the terms under which
22 said settlement will be made has been prepared and reviewed by the
23 City Council and found to be fair and equitable;
24 NOW, THEREFORE, BE IT RESOLVED that the Mayor and City
25 Clerk are hereby authorized and directed to execute said contract c
26 behalf of the City.
