1 RESOLUTION NO.
2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF.A
• 3 CONTRACT

5 WHEREAS, the Orange County Flood Control District has
6 constructed the Greenville�Banning Channel; and
7 WHEREAS, in the course of said construction it became
8 necessary for Orange County Flood Control District to acquire
9 additional right of way and in doing so said district brought a
10 Superior Court action designated as No. 77399 in which said right
11 of way was being acquired by eminent domain; and
12. WHEREAS, the City of Newport Beach owns ten acres more or
13 less, a portion of which is being taken for use in the construction
14 of said channel, said portion being designated Parcel No. D3 »120.1
15 in said Superior Court action; and
16 WHEREAS, the Orange County Flood Control District has
17 prepared a right of way contract in which it offers to pay the City
18 of Newport Beach the total sum of $13,200 for said parcel, said sum
19 to include any damages or interest due to the City as a result of
20 the Districtts taking possession of said parcel on July 1, 1958;
21 and
22 WHEREAS, it appears that the amount offered is a fair
23 price for the property and the contract is fair and equitable and
24 in the interest of the City of Newport Beach;
25 NOW, THEREFORE, BE IT RESOLVED that the Mayor and City
26 Clerk be and are hereby authorized to execute the same on behalf of
27 the City.
