A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH RESCINDING ITS RESOLUTION NO. 5320
AND AUTHORIZING THE EXECUTION OF AN AGREEMENT
WITH NEWPORT BEACH SCHOOL DISTRICT
WHEREAS, pursuant to City Council Resolution No. 5320
the Mayor and City Clerk executed an agreement between the City
of Newport Beach and the Newport Beach School District for the
cooperative use of their recreational facilities, areas, and
equipment for purposes of community recreation; and
WHEREAS, the Newport Beach School District has requested,
that said agreement be revised to provide for the carrying of
public liability insurance and a hold harmless provision in con-
nection therewith by said parties before the execution thereof by
said parties; and
WHEREAS, there has been presented to the City Council of
the City of Newport Beach a certain agreement between the City of
Newport Beach and the Newport Beach School District which has been
revised to include the provisions requested by the Newport Beach
School District; and
WHEREAS, the City Council has considered the terms and
conditions of said revised agreement and found them to be reason-
able and equitable and in.'--the interests of the City;
NOW, THEREFORE, BE IT RESOLVED that Resolution No. 5320
adopted October 10, 1960, is hereby rescinded.
BE IT FURTHER RESOLVED that the revised agreement be
approved and the Mayor and City Clerk are hereby authorized and
directed to execute the same on behalf of the City of Newport
Beach,
