2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ESTABLISHING A POLICY FOR THE
3 PLANTING AND MAINTENANCE OF STREET TREES IN
PARLAYS OF.ESTABLISHED COMMERCIAL AND RESI ->

WHEREAS, it is important that the City establish a
7
policy that will encourage the planting and maintenance of street
8
trees in parkways in both commercial and residential areas of the

City; and .

WHEREAS, the Parks, Beaches and Recreation Commission
11
has reviewed the problem of planting and maintaining trees and has
12
recommended a policy with which the City Council agrees;
13
NOW, THEREFORE, BE IT RESOLVED that the City Council of
14
the City of Newport Beach hereby establishes the following policy
15
for planting and maintaining street trees for established com-
16I
mercial and residential areas of the City:

1. Tree planting in parkways and other rights-of-way
18
shall require the approval of the Parks, Beaches and Recreation
19
Department of the City with respect to type of tree, location and
20
spacing and, if in the right -of -way of a state highway, the ap-
21
proval of the Division of Highways of the State which the City wil
22I
seek to obtain.

2. Upon application by a property owner or interested
24
party and the payment of a fee of $5 for each tree in a residen-
25
tial area and $20 for each tree in a commercial area, the City
26
shall, as manpower is available, furnish, install, stake, and
27
fertilize trees in streets and parkways.

3. The City shall prune and spray street trees as
29
required and in commercial areas shall provide watering, ferti-
30
lizing and weeding.

4. When trees of larger than minimum size are requeste
32
or when there are unusual problems of installation, the added cost

must be paid by the person applying for the tree to be installed.
BE IT FURTHER RESOLVED that nothing herein shall relieve
land developers or subdividers from providing street trees as
required by the provisions of the Municipal Code relating to sub-
divisions.
