III RESOLUTION N0. .535
2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXEECUTION OF A
3 CONTRACT WITH FRANK H. AYRES & SON TO SHARE THE
COST OF.DRAINAGE FACILITIES

5 WHEREAS, as a result of changing the elevation of a
6 portion of Tract No. 772 in the City, surface water will no longer
7 flora from a portion of Seashore Colony Tract, and
8 WHEREAS, Frank H. Ayres & Son, the developers of Tract
9 No. 772, and the City have arrived at an agreement whereby a
10 drainage facility will be constructed through which said surface
11 water will be collected and discharged into the old Santa Ana
12 River Channel; and
13 WHEREAS, said agreement provides that Ayres and the City
14 should share equally in the cost of such drainage facility, which
1:5I is estimated to be $12,000; and
16j WHEREAS, it is in the interests of the property owners
if
171 in said area and in the public interest that said facility be
1811 constructed;
19 NOW, THEREFORE, BE IT RESOLVED that the Mayor and City
20 Clerk be and are hereby authorized and directed to execute a
21 written contract with Frank H. Ayres & Son providing for the
22 construction of said facility and sharing the cost thereof.

regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
the Z3d day of January 19 61 by the following
vote, to wit:
