RESOLUTION NO. 5390
2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF A
• 3 CONTRACT REGARDING OFF-STREET PARKING.

WHEREAS, the Newport Beach Municipal Code provides that
g
off - street parking may be provided on a site other than the build -
7
ing site on condition that an agreement between the property owner
g
and the City is executed and recorded providing that the off-
9
street parking shall be provided and maintained on a designated
10
parcel of land for the duration of the proposed use or uses on the
11
building site or sites; and
12
WHEREAS, Richard W. Beamish and Ronald K. Diggins, d.b.a.
13
Beamish and Diggins, and Frank C. Cortese, wish to construct a
14
restaurant on Lots 4 and 5 in Block 159 of River Section in the
15
City of Newport Beach and are willing to provide the off - street
16
parking on Lots 14 and 15 in Block 160 of River Section in Newport
17
Beach; and
18
WHEREAS, a contract has been prepared under which it is
19
agreed that said off -site parking will be provided and maintained;
20
NOW, THEREFORE, BE IT RESOLVED that the City Council
21
hereby approves said agreement and the Mayor and City Clerk are
22
authorized and directed to execute the same on behalf of the City.

BE IT FURTHER RESOLVED that the City Clerk is authorized
24
and directed to record said agreement and execute any certificate
25
necessary to accomplish said recording.
