A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH PROHIBITING PARKING ON THE WEST - 3 SIDE OF NEWPORT BOULEVARD NORTHERLY OF PACIFIC COAST HIGHWAY 4 5 WHEREAS, Section 3272 of the Newport Beach Municipal 6 Code provides that the city traffic engineer shall sign or mark 7 any place where he determines it is necessary to prohibit parking 8 in order to eliminate an unusual traffic hazard, and when so signed 9 or marked no person shall park a vehicle at any such place; and 10 WHEREAS, Section 22506 of the California Vehicle Code 11 provides that local authorities may by resolution prohibit the 12 parking of vehicles on a state highway if such resolution is first 13 submitted to and approved by the Department of Public Works; and 14 WHEREAS, the city traffic engineer has recommended that 15 parking be prohibited on the west side of Newport Boulevard from 16 the north side of Pacific Coast Highway northerly to the curb 17 I return of the on -ramp in order to eliminate an unusual traffic 18 hazard; 19 NOW, THEREFORE, BE IT RESOLVED that parking be prohibited 20 on the west side of Newport Boulevard from the north side of 21 Pacific Coast Highway northerly to the curb return of the on -ramp. 22 BE IT FURTHER RESOLVED that the city traffic engineer be 23 authorized and directed to sign and mark said area indicating that 24 parking is prohibited as provided in Section 3272 of the Newport 25 Beach Municipal Code. 26 Any provision of this resolution which regulates traffic 27 or delegates the regulation of traffic upon state highways in any 28 way for which the approval of the Department of Public Works is 29 required by state law, shall cease to be operative six months after 30 receipt by the City Council of written notice of withdrawal of 31 approval of the Department of Public Works. 32 Whenever this resolution delegates authority to a city • J 1 officer, or authorizes action by the City Council to regulate 2 traffic upon a state highway in any way which by state law 3 requires the prior approval of the Department of Public Works, no 4 such officer shall exercise such authority nor shall such action 5 by the City Council be effective with respect to any state highway 6 without the prior approval in writing of the Department of Public 7 Works when and to the extent required by Division 11 and Division 8 15 of the Vehicle Code. 9 ADOPTED this /off day of April?' 10 11 Mayor 12 ATTEST: T 13 I k.,,._.
