1 II RESOLUTION No. 5407
2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE MCECUTION OF AN
3 AGREEMENT WITH MICHAEL.D. KAY AND VIVIAN N. KAY,
SUBDIVIDERS, FOR.THE,CONSTRUCTION OF IMPROVEMENTS
4 IN TRACT NO. 4106

6 WHEREAS, there has been presented to the City Council of
7 the City of Newport Beach an agreement in which Michael D. Kay and
8 Vivian h.. Kay, subdividers of Tract No. 4106, agree to construct
9 street and other p�sI is improvements necessary to serve said sub -
10 division; and
11 AREAS, subdividers have furnished seeuaity to assure
12 the faithful performance under said agreement in accordance with
13 the Newport Beach Municipal Code; and
14 A REAS, the City Council has reviewed said agreement and
15 found the same to be fair and equitable and in accordance with the
16 provisions of the Code;
17 NUU2 THEREFORE, BE IT RESOLVED that the Mayor and City
18 Clerk be and are hereby authorized and directed to execute the
19 same on behalf of the City of Newport Beach at such time as said
20 security is approved by the City Manager as to sufficiency and the
21 City Attorney as to form.
