Intention Yro. 54155, declaring its intention to order the vaca fan,
closing up and abandon=.,ment of portions of a certain street '_Ammm
as Neptune Avenue fan the City of k?ew.port Beach, therein more
?artincnzlarly described, pursuant to and in accordance with Vne
["Street Vacation Act of 1941`P, and all amendments thereto, bel.uo
Sections 8330 to 5331, inclusive, of the Streets and Hight-rays Code
of the State Of California; and
rrT REAS, the Street Superintendent of the City of 'Hewpozz-
Beaclh has caused to be roosted conspicuously alonag the lines of the
portions of said street proposed to be vacated, not more than 3CC
feet apart, and not less than three in all, notices of the vacation
of said portions of said street, all of Which will more f�11 aa?ea
from the affidavit of 1. W. Covert, Street Superintendent of t'_ae
City of Mewsmort Beach, on ?File in these proceedings; and
E - MMEA5, said notices so frosted by the Street Superin-
tendent of the. City of Newport Beach stated the passage of said
Resolution of Intention iVo. 5455 aforesaid, and the time and k:race
of the hearing of all persons interested in or objecting to the
2r020sed vacation of said portions of said street; and

time, and the Council C°aawber of the City Council of the City of
Newport Beach, located in tine City Hall of the City of Newport

or objecting to the proposed vacation of said portions of said
street; and

T-FEIMAS, said Resolution of Intention No. 5455 aforesaid
has been published at least once in the Newport Harbor News Press,
a newspaper of general circulation, printed, published and circu-
lated in the City of IJewport Beach, aid said publication was made
more than 15 days prior to the date set for the hearing of all
persons interested :Ln or objecting to the proposed vacation, all of
which will more fully appear by the affidavit of Bean Reddick, owner
and publisher of said Newport Harbor News Press, on file in these
proceedings; and
WIE SAS, the City ,Council of the City of Newport Beao
hag heard t'_ae evidence, both written and verbal, of all persons
interested in the vacations of the portion of said street in this
resolution more particularly hereinafter described, and finds fresr
all the evidence submitted that said portion of said street de-
scribed in said Resolution of Intention, and ',nereinnafter described,
is unnecessary for present or prospective public street purposes;
NCW, T.-IMMFORE, the City Council of the City of Wawaport
Beach finds and determines and hereby orders that the following
described portion of that certain stcreet knowscn as Nep {_ur.e street
in the City of Ivrew port Beach, to wit:
Parcel 01
All that portion of an easement for street purposes, thirty
(3 0) feet in width, deeded to the City of Newport 3eacl3,
November 15, 1927, and recorded in Book 96, page 228 of
0fficiaA ?3ecords of Orange County, California, lying north-
westerly of a lime parallel with and 122.00 feet nort'a-
westerly of the northwesterly line of 54th Street, as 54t.
Street is sHoTm on a map of River Section recorded in
Book 4. page 25 of Kiscellanneous baps, records of said
Crange Co;nty and southeasterly of the following describes
line:
Beginning at a point in the northeasterly Nude of
Seashore give, as described in Final Decree of
ConLde=etioas entered in Superior Court Case No.
281444 in annd for said County of ore 82 a certified
copy thereof being recorded in Book 9903, page 333 of
Official Records, Orange County; said point being
d..sta;.nt southeasterly alonag said ;:northeasterly lime
of Seashore give 450.00 feet from tine intersection
of said northeasterly like with t7ie westerly lime of

thence northerly, is a direct line, to the most West-
erly corner of Lot "A" of Tract No. 3162, as shmn on
map recorded in Book 95, pages 16, 17 and 1.03 of Yjaps,
records of Orange County,
is unnecessary for present or ,prospective public street purposes,
and that it be vacated, closed up and abandoned.
The City Couacil further finds and determines, and it is
hereby ordered, that the public easement is the portion of said
street as heretofore described has, upon the passage of this reso-
lution, ceased.
The City Council further orders that the City Clerk of
the City of Newport Beach shall cause a certif_;.ed copy of this
Order, duly attested by her as the City Clerk, under the seal of
the City, to be recorded in the office of the County Recorder of
the County of Orange, State of California, immediately following
the passage of this resolution.

regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on.
the 14th day of August , 1961 , by the following
vote, to wit:
