RESOLUTION NO. 5477
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH RESCINDING A CONTRACT WITH CLIFFTOP
DEVELOPMENT COMPANY AND AUTHORIZING THE EXECUTION
OF A NEW CONTRACT
WHEREAS, Clifftop Development Company, a limited partner-
ship, and the City of Newport Beach entered into a contract dated
March 27, 1961, which was executed by the City pursuant to the
authorization of Resolution No. 5389 of the City Council; and
WHEREAS, Clifftop Development Company has requested that
that contract be rescinded and the City become a party to a contra
in which The Sturtevant Corporation, Ivan Wells & Sons, Inc.,
South Coast Construction Co., Upper Bay Development Co., Inc., and
the City of Newport Beach are all parties and in which The Irvine
Company acts as stakeholder for the construction of a storm drain
required by said contract; and
WHEREAS, the City Council has reviewed the terms of said
proposed contract and determined that the cost to the City is the
same as under the existing contract between the City of Newport
Beach and Clifftop Development Company; and
WHEREAS, it is mutually convenient to rescind the contrac
with Clifftop and execute the proposed agreement with the other

NOW, THEREFORE, BE IT RESOLVED that the City of Newport
Beach hereby accepts the offer of Clifftop Development Company to
rescind said contract dated March 27, 1961, and authorizes and
directs the Mayor and City Clerk to execute said proposed contract
on behalf of the City of Newport Beach.
