'ab'� A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING ITS INTENTION TO ORDER THE CLOSING UP, VACATION AND ABANDONMENT OF A CERTAIN PUBLIC WALMJAY EASEMENT JN TRACT NO. 3660 The City Council of the City of Newport Beach, pursuant to the provisions of the "Street Vacation Act of 1941 ", and all amendments thereto, being Sections 5300 to 5331, inclusive, of the Streets and Highways Code of the State of California, does hereby resolve and declare as follows: SECTION 1. The public interest and convenience require the closing up and abandonment of a certain public walkway easement in Tract No. 3660 in the City of Newport Beach, and it is the intention of the City Council of the City of Newport Beach to order the following described public walkway easement in Tract No. 3660 in the City of Newport Beach, County of Orange, State of California to be vacated, closed up and abandoned, to wit: A portion of Tract No. 3660 in the City of Newport Beach, Orange County, California, as said Tract No. 3660 is shown on a map thereof recorded in Book 144, pages 9 to 11 inclusive of Miscellaneous Maps, records of said Orange County, more particularly described as follows: The Southeasterly 10 feet of the Northwesterly 20 feet of Lots 44 and 45 of said Tract No. 3660, said South- easterly 10 feet being shown on said Tract map as 1110' Easement for Walkway *" All of that public walkway easement to be vacated, closed up and abandoned is more clearly shown as Parcel No. 1 on a certain map approved and adopted by the City Council of the City of Newport Beach for said vacation, closing up and abandonment, by resolution dated °as, 1961, and designated "Resolution No._Sua , which said map is on file in the office of the City Clerk of the City of Newport Beach. Reference is hereby made to said map for further particulars as to the proposed vacation, closing up and abandonment of said public walkway easement, and said map is made a I part of this resolution by this reference to the same extent and 2 purpose as if it were incorporated herein in full. 3 SECTION 2. The proceedings for the closing up and aban- 4 donment of the aforesaid public walkway. easementshall be had and 5 taken, and the City Council of the City of Newport Beach hereby 6 elects to proceed under the provisions of the "Street Vacation Act 7 of 1941°9, and all amendments thereto, being Sections 8300 to 83310 8 inclusive, of the Streets and Highways Code of the State of 9 California. 10 SECTION 3. The Street Superintendent of the City of 11 Newport Beach shall cause to be conspicuously posted along the 12 line of said public walkway easement proposed to be vacated, not 13 more than 300 feet apart, but not less than three in all, notices 14 of the vacation of said public walkway easement. Said notices 15 shall state the passage of this Resolution of Intention and the 16 time and place of the hearing of all persons interested in or 17 objecting to the proposed vacation of said public walkway easement. 18 Said notices shall be so posted at least ten days before the date 19 of said hearing, all as required by law. 20 SECTION 4. Notice is hereby given that the City Council 21 of the City of Newport Beach does hereby fix Monday, them -d, day 22 of October, 1961, at the hour of 7:30 o'clock P. M. of said day, in 23 the Council Chambers of the City of Newport Beach, located in the 24 City Hall of the City of Newport Beach, as the time and place for 25� hearing all persons interested in or objecting to the proposed 26 vacation of said public walkway easement, and the City Council at 27 said time and place will hear the evidence offered by any person 28 interested in the vacation of said public walkway easement herein - 29 before described. 30 SECTION 5.
