RESOLUTION NO. 5483
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH CONFIRMING SUPPLEMENTAL STATEMENT
OF EXPENSE OF ABATING A PUBLIC NUISANCE
WHEREAS, Oliver A. Ring, Senior Building Inspector of
the City of Newport Beach,has submitted to the City Council of
the City of Newport Beach at its regular meeting on.Monday,
October 9, 1961, at the hour of 7:30 o'clock P. M..in the Council
Chambers at the City Hall, Newport Beach, California, a supple-
mental statement of the expense of abating a public nuisance, to
wit: the expense of the removal and storage of personal property
located in and around the buildings heretofore removed from 904 -
906 East Balboa Boulevard and 905 - 907 East Bay Avenue, Newport
Beach, California; and
WHEREAS, a copy of said.statement and notice of hearing
before said City Council was posted conspicuously on said,property
and mailed to Mr. Roger B. Van Pelt, 1611 Milan Street, South Pasa-
dena, California, as required by and in accordance with the State
Housing Act, Division 13, Part 1, of the Health and Safety Code of
the -State of California;
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Newport Beach, acting pursuant to the State Housing
Act and the Uniform Building Code, hereby finds and determines as
follows, to wit:
1. The City Council ratifies and confirms the act of
Oliver A. Ring in engaging Balboa Transfer Company to remove and
store said personal property.
2. The net expense hereby acknowledged and confirmed
of removing.and storing said personal property is $1,056.70, which
is in addition to the sum of $1400 heretofore determined by Reso-
lution No:. 5247 to be the cost of removing the buildings from said
property.
BE IT FURTHER RESOLVED that the City Attorney is hereby
authorized and directed to file an action, or file an amendment
in the present Superior Court action, Newport Beach vs. Van Pelt,
under Superior Court No. 91529, to enforce the City's lien rights
against the property and to collect the sums declared to be the
cost of abating the said public nuisance by Resolution No. 5247
and this resolution.
