NEWPORT BEACH AUTHORIZING THE O EXECUTI OF AN
3 AGREEME14T 14ITH CLIFFTOP DEVELOPMENT COMPANY,
SUBDIVIDER, FOR THE CONSTRUCTION OF IMPROVEMENTS
4 IN TRACT NO. 3851

6 WHEREAS, there has been presented to the City Council of
7 the City of Newport Beach an agreement in which Clifftop Developmei
8 Company, subdivider of Tract No. 3851, agrees to construct street
9 and other public improvements necessary to serve said subdivision;
10 and.
11 WHEREAS, subdivider has furnished security to assure the
12 faithful performance under said agreement in accordance with the
13 Newport Beach Municipal Code; and
14 WHEREAS, the City Council has reviewed said agreement an
15 found the same to be fair and equitable and in accordance with the
16 provisions of the Code;
17 NOW, THEREFORE, BE IT RESOLVED that the Mayor and City
18 I Clerk be and are hereby authorized and directed to execute the
19 same on behalf of the City of Newport Beach at such time as said
20 security is approved by the City 'Planager as to sufficiency and the
21 City Attorney as to form.
