RESOLUTION NO. 5490
A RESOLUTION OF THE CITY COUNCIL OF T11E CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF A
CONTRACT REGARDING OFF- STREET PARKING
I9WREAS, the Newport Beach Municipal Code provides that
off-street parking may be provided on a site other than the build-
ing site by the property owner, on condition that an agreement
between the property owner and the City is executed and recorded
providing that off- street parking shall be provided and maintained
on a designated parcel of land for the duration of the proposed use
or uses on the building site or sites, and
WHEREAS, the property owners of Lots I and 2 of Tract
1133, as shown on a map thereof recorded in Book 36, pages 13 and
14, of Miscellaneous Maps, Records of Orange County, California,
propose to change the use of a building on said Lots I and 2 of
Tract 1133, which lots are located in a C -1 -H Zone of the City in
which off - street parking is required by the Newport Beach Municipal
Code; and
WHEREAS$ said off - street parking is a condition necessary
to conform the proposed new use of Lots 1 and 2.of Tract 1133 to
the requirements of said C -I -H Zone, and
WHEREAS, the property owners also own Lots 14 and 15 of
Tract 1133 in close proximity to said building site on Lots I and
2 of Tract 1133, on which they propose to provide the off - street
parking which is required by said Code as a condition of the pro-
posed new use of said building on Lots I and 2; and
WHEREAS, a contract has been prepared under which it is
agreed that said off -site parking will be provided and maintained
on Lots 14 and 15 for the benefit of Lots I and 2 of Tract 1133;
N%12 THEREFORE, BE IT RESOLVED that the City Council
11 hereby approves said agreement and the Mayor and City Clerk are
authorized and directed to execute the same on behalf of the City

and directed to record said agreement and execute any certificate
necessary to accomplish said recording.
ADOPTED this 9th day of October, 1961.
